Inviting of Public Comments regarding an Ordinance Proposal to Partial Revise the Radio Act Related Screening Standards

Revision of the Obstruction Criteria of High-Rise Buildings concerning the Prevention of Interference with Radio Waves

The Ministry of Internal Affairs and Communications (MIC) has created a revision proposal to partial revise the Radio Act related screening standards for obstruction criteria of high-rise buildings for the prevention of radio wave interference.

Therefore, the MIC will be accepting public comments start today until January 4, 2010 regarding this revision proposal.

Summary

Article 102 Section of the Radio Act (1950 Act No. 131) designates and gives notice for areas where propagation should be protected from interference, including the securing of communications within the radio propagation path of important wireless communications using fixed stations which are considered necessary.

Pursuant to Article 102 Section 3 paragraph 1 of the Radio Act, notification from building owners is necessary for building a building or expanding onto one which is taller than 31 meters within the area where interference to propagation is protected. If it is determined that the building or building addition interferes with the radio propagation route of important wireless communications then construction will be limited to at most 2 years, as stipulated in Article 102 Section 6 of the same act.

This revision is to improve the efficiency and precision of judgments, make standards for detailed determinations more clear and to use the limited amount of space allocated to high-rise buildings and radio propagation routes in the best way possible.
