Appeal for Opinions on Partial Reform Proposal for Radio Law Enforcement Regulations and Related Bulletins accompanying Partial Enforcement of Law Partially Revising the Broadcast Act, etc.

Revision of related bulletins, etc., accompanying Radio Law reform (to be enforced within three months of promulgation)

The Ministry of Internal Affairs and Communications (MIC) has drawn up a partial reform proposal for Radio Law enforcement regulations and related bulletins accompanying the Radio Law reform (to be enforced within three months of promulgation) included in the Law (Act No. 65 of 2010 Law) partially revising the Broadcast Act, etc.
Accordingly, an appeal for opinions on this reform proposal will be held from January 22 (Sat) to February 21 (Mon), 2011.

1. Background

The Law for partial revision of the Broadcast Act, etc., including Radio Law reform, came into existence at the 176th National Diet and was promulgated on December 3, 2010.
This same law dictates that the provisions set forth in Additional Clause 2 in Article 1 are to be enforced on March 1, 2011, and plans for partial revision of Radio Law enforcement regulations and related ministerial ordinances have been drawn up to service the necessary provisions.
Accordingly, a broad appeal for opinions on the relevant reform proposals will now be conducted.

2. Outline of reform proposal

  1. For small scale base stations for mobile phones, etc. that are installed indoors (femtocell base stations, etc.), the proposal establishes regulation of the necessary codes, etc. for license procedure along with official work papers required by these provisions.
  2. The proposal establishes that persons who were licensed radio operators must separately notify the Minister of Internal Affairs and Communications when their radio station licenses expire.
  3. The proposal also services other regulations as necessary.
