Appeal for Opinions concerning Partial Revision of “Guidelines relating to Application of Laws and Ordinances connected to Radio Law and Telecommunications Business Law concerning Use of Femtocell Base Stations”

The Ministry of Internal Affairs and Communications (MIC) has drawn up a plan for partial revision of “Guidelines relating to Application of Laws and Ordinances connected to Radio Law and Telecommunications Business Law concerning Use of Femtocell Base Stations” accompanying Radio Law reform included in the Law (2010 Law, Act No. 65) for partial reform of the Broadcast Act, etc.
Accordingly, opinions on this plan for revision will be sought from January 29 to February 28 (Mon), 2011.

1. Background

The Ministry of Internal Affairs and Communications (MIC) published “Guidelines relating to Application of Laws and Ordinances connected to Radio Law and Telecommunications Business Law concerning Use of Femtocell Base Stations” on December 2, 2008 with the aim of clarifying the application of laws and ordinances connected to the Radio Law and Telecommunications Business Law from the viewpoint of guaranteeing smooth establishment and suitable use of Femtocell base stations together with implementing smooth and efficient provision of mobile phone services using Femtocell base stations, based on the MIC's earlier “Guidelines for Laws and Ordinances connected to Radio Law and Telecommunications Business Law concerning Use of Femtocell Base Stations,” which were published on April 17, 2008.
Accompanying the partial execution (on March 1, 2011) of the Law for partial revision of the Broadcast Act, etc., which came into existence at the 176th National Diet, a partial reform proposal for these guidelines has been drawn up to facilitate comprehensive Femtocell base station licenses in place of separate licenses for each base station, and there will now be a wide appeal for opinions on this reform proposal.
