From January 22 to February 21, the Ministry of Internal Affairs and Communications (MIC) conducted an appeal for opinions on its partial reform proposal for Radio Law enforcement regulations and related bulletins accompanying the Radio Law reform included in the Law (Act No. 65 of 2010 Law) partially revising the Broadcast Act, etc., in response to which two opinions were submitted. These opinions, along with the views of the MIC, are officially announced herein.
Based on results from the appeal for opinions, the Ministry of Internal Affairs and Communications (MIC) carry out revisions of ministerial ordinances and bulletins, etc.
1. Background
The Law for partial revision of the Broadcast Act, etc., including Radio Law reform, came into existence at the 176th National Diet and was promulgated on December 3, 2010.
This same law dictates that the provisions set forth in Additional Clause 2 in Article 1 are to be enforced on March 1, 2011, and plans for partial revision of Radio Law enforcement regulations and related ministerial ordinances were drawn up to service the necessary provisions, concerning which opinions were sought from January 22 to February 21, 2011.
2. Outline of reform proposal
(1) For small scale base stations for mobile phones, etc. that are installed indoors (femtocell base stations, etc.), the proposal establishes regulation of the necessary codes, etc. for license procedure along with official work papers required by these provisions.
(2) The proposal establishes that persons who were licensed radio operators must separately notify the Minister of Internal Affairs and Communications when their radio station licenses expire.
(3) The proposal also services other regulations as necessary.
3. Results from appeal for opinions
The submitted opinions, along with the views of the MIC, are as per the enclosed document.
4. Schedule
Based on results from the appeal for opinions, the Ministry of Internal Affairs and Communications (MIC) carry out revisions of ministerial ordinances and bulletins, etc.
