Revision of "Guidelines relating to Application of Laws and Ordinances connected to Radio Law and Telecommunications Business Law concerning Use of Femtocell Base Stations," and Results from Appeal for Opinions

 

  The Ministry of Internal Affairs and Communications (MIC) has revised the "Guidelines relating to Application of Laws and Ordinances connected to Radio Law and Telecommunications Business Law concerning Use of Femtocell Base Stations," and the results from the appeal for opinions on the partial revision plan for these guidelines are officially announced herein.


1. Background

  The Ministry of Internal Affairs and Communications (MIC) published "Guidelines relating to Application of Laws and Ordinances connected to Radio Law and Telecommunications Business Law concerning Use of Femtocell Base Stations" on December 2, 2008 with the aim of clarifying the application of laws and ordinances connected to the Radio Law and Telecommunications Business Law from the viewpoint of guaranteeing smooth establishment and suitable use of Femtocell base stations together with implementing smooth and efficient provision of mobile phone services using Femtocell base stations, based on the MIC's earlier "Guidelines for Laws and Ordinances connected to Radio Law and Telecommunications Business Law concerning Use of Femtocell Base Stations," which were published on April 17, 2008.
  Accompanying the partial execution (on March 1, 2011) of the Law for partial revision of the Broadcast Act, etc., which came into existence at the 176th National Diet, a partial reform proposal for these guidelines was drawn up to facilitate comprehensive Femtocell base station licenses in place of separate licenses for each base station, and an appeal for opinions on this reform proposal was held from January 29 to February 28, 2011.


2. Guideline reforms

  The guidelines have been revised as per the attachment. An outline of these reforms is as follows.
(1) Comprehensive license procedure methods for Femtocell base stations will be added as a postscript.
(2) Recorded details will be corrected to reflect partial modifications made to Femtocell base station technical standards.
(3) The proposal also services other regulations as necessary.


3. Results from appeal for opinions

  Eight opinions were received from four proponents.
  The opinions submitted, along with the views of the MIC, are as per the enclosed document.
