From March 5 to April 4, 2011, the Ministry of Internal Affairs and Communications (MIC) held an appeal for opinions on its “draft verification results based on the Competition Safeguard System (FY 2010).” This is to officially announce that verification results based on the Competition Safeguard System (FY 2010) have now been compiled in line with opinions received in the appeal for opinions.
Additionally, on May 13, 2011, requests were issued to Nippon Telegraph and Telephone Corporation East and Nippon Telegraph and Telephone Corporation West concerning measures to be taken based on these verification results (FY 2010).
1. Background, etc.
The Ministry of Internal Affairs and Communications (MIC) has been making use of the Competition Safeguard System since 2007 with the aim of periodically verifying the effectiveness of successive fair competition requirements involving the NTT Group and designated telecommunications equipment systems (including items involving systems for business application approval).
From September 10 to October 8 (Fri), 2010, prior to periodic verification of the System in this fiscal year, the Ministry of Internal Affairs and Communications (MIC) sought opinions on each of the items to be verified as established in the Guidelines for Application of Competition Safeguard System (decided on and published in April 2007, and reformed in July 2008). Also, a repeat appeal for opinions was conducted from October 15 to November 12, 2010.
The Ministry of Internal Affairs and Communications (MIC) carried out verifications based on opinions received during the above-mentioned appeals and compiled draft verification results, concerning which opinions were sought from March 5 to April 4, 2011, resulting in the submission of nine opinions (see enclosed documents).
This is to officially announce that the Ministry of Internal Affairs and Communications (MIC) has now compiled verification results (see enclosed documents) based on the Competition Safeguard System (FY 2010) in line with opinions received in the appeal for opinions.
The opinions received with regard to draft verification results based on this System can be inspected at the address provided at the end of this document, and will also be published in the “Reports and documents” area of the Ministry of Internal Affairs and Communications (MIC) website (http://www.soumu.go.jp) as well as in the “Public comment” field of e-Gov (http://www.e-gov.go.jp), the electronic coordinated government contact website.
2. Details of verification results
Verification results based on the Competition Safeguard System (FY 2010) are as per the enclosed documents.
The attached documents contain opinions received in the initial and repeat appeals concerning application of this System, opinions received in response to the appeal concerning draft verification results, and the MIC's views on these opinions.
3. Requests concerning measures to be taken based on verification results based on Competition Safeguard System (FY 2010)
On May 13, 2011, in an official document from the Chief of Coordinated Telecommunications Infrastructure Bureau, Ministry of Internal Affairs and Communications (MIC), the Ministry of Internal Affairs and Communications (MIC) sent requests to Nippon Telegraph and Telephone Corporation East (Representative Director and President: Tsutomu Ebe) and Nippon Telegraph and Telephone Corporation West (Representative Director and President: Shinichi Otake) concerning measures to be taken based on verification results based on the Competition Safeguard System (FY 2010).
The requests issued to Nippon Telegraph and Telephone Corporation East and Nippon Telegraph and Telephone Corporation West are as per the enclosed documents.
4. Schedule
The Ministry of Internal Affairs and Communications (MIC) will promptly report these verification results to the Information and Communications Administration and Postal System Administration Council.
