Approval of Modifications for Japan Broadcasting Corporation Broadcasting License Fee Exemption Standards and Broadcasting Reception Rules

 

 On June 14, 2011, the Ministry of Internal Affairs and Communications (MIC) submitted an inquiry to the Radio Regulatory Council (Chairman: Hiroshi Harashima, emeritus professor at The University of Tokyo) concerning approval of an application from the Japan Broadcasting Corporation (Chairman: Masayuki Matsumoto; hereinafter referred to as the “Corporation”) for modification of Corporation Broadcasting License Fee Exemption Standards (hereinafter, “Exemption Standards”) and Corporation Broadcasting Reception Rules (hereinafter, “Reception Rules”) based on regulations in Clauses 2 and 3 of Article 32 of the Broadcast Act (Act No. 132 of 1950 Law), and a reply was received from the Council stating its approval of the motion as per the initial inquiry.
 Having received this reply, the matter will be approved as of June 14, 2011.


1. Modified contents

 The following contents of the Exemption Standards and Reception Rules will be modified, and related regulations will be serviced.

(1) Conducting confirmation surveys for broadcasting license fee exemption
  In order to apply the exemption system in a more suitable manner, the Corporation will periodically conduct surveys, etc. concerning the continuation of grounds for exemption, and will deny exemption from broadcasting license fees when surveys, etc. cannot confirm that grounds for continued exemption exist.
  Confirmation surveys will be conducted annually when there are requirements relating to economic reasons for exemption, and once every two years for all other items.

(2) Servicing of procedures, etc. relating to reception contracts and termination of analog broadcasting
  In order to smoothly and reliably implement procedures concerning contract termination, etc. in relation to the termination of analog broadcasting, regulations will be serviced to effect contract termination on the date of the termination of analog broadcasting, provided that reception of the Corporation's broadcasting has become impossible due to the termination of analog broadcasting and that the content of reports (required to be submitted within one year) has been confirmed as fact. (However, if these reports are proved to have been falsified, such termination shall be retroactively revoked.)


2. Enforcement period

 These modifications will be enforced from July 1, 2011.
 However, for persons receiving exemption in areas applying The Disaster Relief Act (except Tokyo) in relation to the “Tohoku Pacific Ocean Offshore Earthquake Disaster” and the “North Nagano Prefecture Earthquake,” confirmation procedure will remain unenforced for a period of one year ending June 30, 2012.
