Reply from Radio Regulatory Council concerning Maintenance of Relevant Ministerial Ordinance Plans, etc. accompanying Enforcement of Law for Partial Revision of Broadcast Act, etc., and Results from Appeal for Opinions

 

 On June 14, 2011, the Ministry of Internal Affairs and Communications (MIC) submitted an inquiry to the Radio Regulatory Council (Chairman: Hiroshi Harashima, emeritus professor at The University of Tokyo) concerning necessary items in relevant ministerial ordinance plans, etc. accompanying the revision of the Broadcast Act and Radio Law (to be enforced within nine months of promulgation of the Law) included in the Law for Partial Revision of the Broadcast Act, etc. (Act No. 65 of 2010 Law), and a reply was received from the Council stating its approval of the original plans.
 There was also an appeal for opinions concerning the relevant ministerial ordinance plans (technical standards for safety and reliability, etc.) held from April 28 to May 27, 2011 (and from May 19 to June 3, 2011 for technical requirements relating to the safety and reliability of broadcasting equipment based on the effects of the Eastern Japan Great Earthquake Disaster), in response to which 14 opinions were submitted. These opinions, along with the views of the MIC, are officially announced herein.


1. Background

 The Law for Partial Revision of the Broadcast Act, etc., came into existence at the 176th National Diet and was promulgated on December 3, 2010.
 The same Law also dictates that, except for provisions set forth in the first article of supplementary provisions, enforcement is to be carried out within nine months from the date of the promulgation of the Law, and accordingly the MIC created relevant ministerial ordinance plans (technical standards for safety and reliability, etc.) in order to carry out maintenance, etc. of regulations that are necessary to achieve this. Accordingly, an appeal for opinions on these plans was held from April 28 to May 27, 2011 (and from May 19 to June 3, 2011 for technical requirements relating to the safety and reliability of broadcasting equipment based on the effects of the Eastern Japan Great Earthquake Disaster).

3. Reply from Council, and results from appeal for opinions

 (1) On June 14, 2011, the Ministry of Internal Affairs and Communications (MIC) submitted an inquiry to the Radio Regulatory Council concerning necessary items in relevant ministerial ordinance plans, etc., and a reply was received from the Council stating its approval of the original plans.
 (2) An appeal for opinions concerning these relevant ministerial ordinance plans, etc., was held as outlined above, in response to which 14 opinions were submitted. These opinions, along with the views of the MIC, are as per the enclosed documents.


4. Schedule

 Based on the reply from the Radio Regulatory Council and results from the appeal for opinions, the Ministry of Internal Affairs and Communications (MIC) will promptly revise the relevant ministerial ordinances, etc.

 *The enclosed references contain a reform plan for ministerial ordinances and main bulletins (Broadcasting Diffusion Basic Plan, Frequency Allocation Plan, etc.) serviced in light of the Radio Regulatory Council reply and results from the appeal for opinions of April 13, 2011, as well as the reply and results from the appeal for opinions detailed herein, accompanying enforcement of the the Law for Partial Revision of the Broadcast Act, etc. (to be enforced within nine months from the date of the promulgation of the Law).
