On June 20, 2011, the Ministry of Internal Affairs and Communications (MIC) received a reply from the Telecommunications Administration and Postal System Administration Council (Chairman: Atsushi Takahashi, Advisor to Sumitomo Trust and Banking Company, Ltd.) concerning the following inquiries: Inquiry No. 2004, dated April 7, 2011(concerning ruling on retransmission agreement requested by Yosakoi Cable Net, Inc.); Inquiry No. 2005, dated May 18, 2011 (concerning ruling on retransmission agreement requested by Yamaguchi Cable Vision Co., Ltd.); and Inquiry No. 2006, also dated May 18, 2011 (concerning ruling on retransmission agreement requested by Mine City).
1. Outline of reply
(1) For Inquiry No. 2004 (concerning ruling on retransmission agreement requested by Yosakoi Cable Net, Inc.), the reply received stated that the ruling should not approve the matter to be agreed.
(2) For Inquiry No. 2005 (concerning ruling on retransmission agreement requested by Yamaguchi Cable Vision Co., Ltd.), the reply received stated that the ruling should approve the fact that the matter must be agreed.
For Inquiry No. 2006 (concerning ruling on retransmission agreement requested by Mine City), the reply received stated that this request should be denied.
2. Background to deliberation
(1) Inquiry No. 2004 (concerning ruling on retransmission agreement requested by Yosakoi Cable Net, Inc.)
On June 24, 2010, a request for a ruling by the Minister of Internal Affairs and Communications was received from Yosakoi Cable Net, Inc. (a cable television broadcasting business active in Kochi prefecture) concerning an agreement to retransmit the television broadcasting of TV Setouchi Broadcasting Co., Ltd. (a broadcasting business active in Okayama and Kagawa prefectures) based on Article 13.3 of the Cable Television Broadcast Act (Act No. 114 of 197 Law).
On April 7, 2011, the Ministry of Internal Affairs and Communications (MIC) submitted an inquiry to the Telecommunications Administration and Postal System Administration Council concerning this ruling, based on Item 2.3 in Article 26 of the same Act.
Subsequently, on June 20, 2011, a reply was received from the Council based on its deliberation.
(2) Inquiry No. 2005 (concerning ruling on retransmission agreement requested by Yamaguchi Cable Vision Co., Ltd.) and Inquiry No. 2006 (concerning ruling on retransmission agreement requested by Mine City)
On March 30, 2011, a request for a ruling by the Minister of Internal Affairs and Communications was received from Yamaguchi Cable Vision Co., Ltd. (a cable television broadcasting business active in Yamaguchi prefecture) and Mine City concerning an agreement to retransmit the television broadcasting of four broadcasting businesses in Fukuoka prefecture (Fukuoka Broadcasting Corporation, RKB Mainichi Broadcasting Corporation, Kyushu Asahi Broadcasting Co., Ltd., and TVQ Kyushu Broadcasting Co., Ltd.) based on Article 13.3 of the Cable Television Broadcast Act (Act No. 114 of 197 Law).
On May 18, 2011, the Ministry of Internal Affairs and Communications (MIC) submitted an inquiry to the Telecommunications Administration and Postal System Administration Council concerning this ruling, based on Item 2.3 in Article 26 of the same Act.
Subsequently, on June 20, 2011, a reply was received from the Council based on its deliberation.
