Partial Revision of “Guidelines for Interpretation of 'Justifiable Reasons' in Consultation Procedures and Arbitration concerning Agreements on Rebroadcasting of Main Broadcasters' Key Broadcasting (Limited to Television Broadcasting) by Cable Television Broadcasters”

This is to officially announce that on July 1, 2011 the Ministry of Internal Affairs and Communications (MIC) partially revised the “Guidelines for Interpretation of 'Justifiable Reasons' in Consultation Procedures and Arbitration concerning Agreements on Rebroadcasting of Main Broadcasters' Key Broadcasting (Limited to Television Broadcasting) by Cable Television Broadcasters” (decision made in April 2008; hereinafter, “Rebroadcasting Guidelines”).


Background

 This is to officially announce that in order to encourage consultations concerning rebroadcasting agreements while also clarifying the interpretation of “justifiable reasons” in arbitration, the Ministry of Internal Affairs and Communications (MIC) has partially revised the “Rebroadcasting Guidelines” (officially announced in April 2008), with four relevant laws including the Cable Television Broadcast Law having been incorporated in the Broadcasting Act (Act No. 132 of 1950 Law) in accordance with the Law for Partial Revision of the Broadcast Act, etc. (Act No. 65 of 2010 Law) promulgated on December 3, 2010.
