The Ministry of Internal Affairs and Communications (MIC) enacted the “Ministerial Ordinance Establishing Sender Information in Article 4, Clause 3 of Act on the Limitation of Liability for Damages of Specified Telecommunications Service Providers and the Right to Demand Disclosure of Identification Information of the Senders” (2002 Ministry of Internal Affairs and Communications (MIC) Order No. 57; hereinafter, “the ministerial ordinance”) in 2002.
A plan for the revision of this ministerial ordinance (hereinafter, “revised ministerial ordinance plan”) has been drawn up based on proposals from the “Research Society Examining ICT Service Problems based on End User Opinions” (Chairman: Masao Horibe, emeritus professor at Hitotsubashi University).
Accordingly, opinion on this revised ministerial ordinance plan will be sought from July 26 (Tue) to August 25 (Thu), 2011.
1. Outline of revision plan
This plan adds to the ministerial ordinance user identification codes for Internet connection services from mobile telephone terminals, etc. (revised ministerial ordinance plan no. 5), SIM card identification codes (revised ministerial ordinance plan no. 6) and related time-stamps (revised ministerial ordinance plan no. 7), based on the “Proposal concerning Verification of Law for Limited Liability of Providers” (July 21 (Thu), 2011) from the “Research Society Examining ICT Service Problems based on End User Opinions,” in which the view was expressed that there should be added sender information subject to disclosure by the Act on the Limitation of Liability for Damages of Specified Telecommunications Service Providers and the Right to Demand Disclosure of Identification Information of the Senders (Act No. 137 of November 30, 2001; “Law for Limited Liability of Providers”) in relation to so-called personal identification numbers used to identify mobile telephone users.

(2) Deadline for submission of opinions
Must arrive no later than 17:00 on August 25 (Thu), 2011 (mailed submissions must bear a postmark of no later than this date)
