Appeal for Opinions on Ministerial Ordinance Plan for Partial Revision of Telecommunications Business Law Enforcement Regulations

 On July 26, 2011, the Information and Communications Administration and Postal System Administration Council received an inquiry from the Minister of Internal Affairs and Communications concerning “Partial Revision of Regulation for enforcement of the Telecommunications Business Law Enforcement Regulations.” Accordingly, an appeal for opinions on this ministerial ordinance plan will be held from July 27 (Wed) to September 2 (Fri), 2011.


1. Ministerial ordinance plan outline

 The Law for Partial Revision of the Telecommunication Business Act and Act Concerning Nippon Telegraph and Telephone Corporation, etc. (Act No. 58 of 2011 Law) came into existence at the 177th National Diet, held on May 26, 2011.


 The ministerial ordinance plan detailed in the inquiry submitted to this Council service regulations necessary for establishment of the following items in view of the legal reform mentioned above.

(1) Details of system maintenance and other corrective measures to be taken to ensure suitable competitive relationships between businesses that install bottleneck equipment and other businesses
(2) Details of items to be reported in relation to applicable system maintenance and subsidiary supervisors' adherence to regulations, etc.

2. Outline of appeal for opinions
 Subject of appeal for opinions: “Ministerial Ordinance Plan for Partial Revision of Regulation for enforcement of the Telecommunications Business Act”
 Deadline for submission of opinions: Must arrive no later than 17:00 on September 2 (Fri), 2011 (mailed submissions must also arrive by this date)

Please note that the ministerial ordinance plan will be published in the “Reports and documents” area of the Ministry of Internal Affairs and Communications (MIC) website (http://www.soumu.go.jp) and in the “Public comments” section of the e-Gov coordinated electronic government contact website (http://www.e-gov.go.jp),and will also be made available for inspection at the Ministry of Internal Affairs and Communications (MIC) Information and Communications Bureau, General Affairs Division (11th Floor, MIC).


3. Schedule

 A report on this ministerial ordinance plan will be sent to the Minister for Internal Affairs and Communications, based on study and deliberation of the opinions submitted during this appeal.
