Appeal for Opinions on Plans for Partial Reform of Guidelines for Personal Information Protection in Telecommunications Business and Explanation

 The Ministry of Internal Affairs and Communications (MIC) is applying "Guidelines for Personal Information Protection in Telecommunications Business" (2004 MIC Bulletin No. 695; hereinafter, "Guidelines") that were settled on in August 2004 with the purpose of improving the user-friendliness of telecommunications services and protecting consumer rights and interests.
 As a result of discussions regarding location information carried out between the government agencies concerned, plans have now been drafted to reform the Guidelines and their explanation by servicing the relevant regulations.
 Accordingly, from August 2 (Tue) to August 31 (Wed), 2011, an appeal will be carried out for opinions on these reform plans.


1. Outline of reform plans

 As a result of discussions between government agencies, these reforms service the following regulations and explanations that are necessary when telecommunications businesses acquire location information.

About location information (Article 26 of the Guidelines, and explanation of said article)
 Regardless of the regulations in Article 4 of the Guidelines, it is to be clearly stated that telecommunications businesses must only acquire location information when consumers are able to know that their location information is being acquired, and when abiding by written orders issued by a judge.

 Please note that both of these reform plans will be distributed via the contact address provided at the end of this document and will also be published in the "Reports and documents" area of the Ministry of Internal Affairs and Communications (MIC) website (http://www.soumu.go.jp) as well as in the "Public comment" section of e-Gov (http://www.e-gov.go.jp), the electronic coordinated government contact website.

(2) Deadline for submission of opinions
 Must arrive no later than 17:00 on August 31 (Wed), 2011 (mailed submissions must also arrive by this date)

3. Schedule

 The Ministry of Internal Affairs and Communications (MIC) will promptly revise the Guidelines and explanations based on the opinions received.
