With the Act on Nippon Telegraph and Telephone Corporation, etc. having been partially revised at the 177th National Diet, the Ministry of Internal Affairs and Communications (MIC) has produced a partial revision of the enforcement regulations for this Act and draft fair competition guidelines for NTT East and West business application.
A broad appeal for opinions on the partial revision plan and draft guidelines will be held from September 13 (Tue) to October 12 (Wed), 2011.
1. Outline of partial revision plan, etc.
(1) Plan for partial revision of Act on Nippon Telegraph and Telephone Corporation, etc. enforcement regulations (1985 Ministry of Posts and Telecommunications Order No. 23)
As well as partially revising the Act on Nippon Telegraph and Telephone Corporation, etc. (Act No. 85 of 1984 Law; hereinafter referred to as the “NTT Act”) and regulating timeframes for reports when intending to run objective/achievement businesses or application businesses, etc. based on the regulations of the same Act, regulations will also be established concerning the publication of report items when reports have been issued.
(2) Draft fair competition guidelines for NTT East and West business application
With partial revision of the NTT Act, regulations will also be established concerning reporting procedure for the running of application businesses, measures to be taken so as to run application businesses within a range whereby there are no obstacles to the maintenance of fair competition, and confirmation protocol and views, etc. on the running of application businesses within this range.
2. Outline of appeal for opinions
Subjects of appeal for opinions:
(1) Plan for partial revision of Act on Nippon Telegraph and Telephone Corporation, etc. enforcement regulations (new-old comparison table)
(2) Draft fair competition guidelines for NTT East and West business application
Deadline for submission of opinions: 17:00 on October 12 (Wed), 2011 (mailed submissions must also arrive by this date)

3. Schedule
The Ministry of Internal Affairs and Communications (MIC) will decide on the ministerial ordinance revision and guidelines based on the opinions received.
