Inquiry Submitted to Information and Communications and Posts Administrative Council concerning Partial Revision of Regulations for Telecommunications Facilities for Telecommunications Business, etc. and Appeal for Opinions on Revised Regulations, etc.

  On March 29, 2012, the Ministry of Internal Affairs and Communications (MIC) submitted an inquiry to the Information and Communications and Posts Administrative Council (Chairman: Atsushi Takahashi, Chairman of Board of Directors at Sumitomo Trust and Banking Company, Ltd.) concerning a ministerial ordinance plan for partial revision of Regulations for Telecommunications Facilities for Telecommunications Business (Ministerial Ordinance of MPT No. 30 of 1985) and Regulations for Enforcement of the Telecommunications Business Act (Ministerial Ordinance of MPT No. 25 of 1985) in order to service regulations relating to the safety and reliability of telecommunications facilities.  
  Accordingly, from March 30 (Fri) to May 1 (Tue), 2012, an appeal for opinions will be held on the Regulations plan and related public notice plans subject to this inquiry.

1. Background and outline of revisions

  The occurrence of the Great East Japan Earthquake Disaster caused problems such as extensive congestion and interruptions, etc. in communications infrastructure, while storm and flood damage from last year's Typhoon No. 12 caused interruption to means of communication in communities in mountainous regions, etc. Therefore, the Information and Communications Council has since September of last year been studying policy towards strengthening measures for the safety and reliability of telecommunications facilities, and a partial report from the Council was received in February of this year.
  Based on this report, this matter services regulations relating to the safety and reliability of technical requirements for power outage countermeasures, etc. in relation to the Regulations for Telecommunications Facilities for Telecommunications Business (Ministerial Ordinance of MPT No. 30 of 1985), etc.
 

2. Subject of appeal for opinions, and outline of public appeal for opinions

  Public notice plan for partial revision Ministry of Internal Affairs and Communications (MIC) Public notice No. 644 of 2007 (item establishing details of management rules)
  Please note that the revised ministerial ordinance plan, etc. (new old comparison table) will be published in the “Reports and documents” area of the Ministry of Internal Affairs and Communications (MIC) website (http://www.soumu.go.jp) as well as in the “Public comments” section of the e-Gov coordinated electronic government website (http://www.e-gov.go.jp).

(2) Deadline for submission of opinions
  Must arrive no later than 17:00 on May 1 (Tue), 2012 (mailed submissions must also arrive by this date) For further details, please see the enclosed outline of the public appeal for opinions.
 

3. Schedule

  The ministerial ordinance and public notices will be revised based on results from the appeal for opinions.
  Please note that of the subjects of this appeal for opinions, results from the appeal for opinions relating to the ministerial ordinance plan that was the subject of an inquiry submitted to the Information and Communications and Posts Administrative Council will be reported to the Council, and will serve as references for deliberation towards the Council's report.
