Partial Revision of the Regulations for Enforcement of the Telecommunications Business Act

Report from the Information and Communications and Posts Administrative Council
  On May 29, 2012, the Ministry of Internal Affairs and Communications (MIC) received from the Information and Communications and Posts Administrative Council (Chairman: Atsushi Takahashi, Advisor to Sumitomo Trust Bank) a report stating its approval of the revision as inquired concerning the “partial revision of the Regulations for Enforcement of the Telecommunications Business Act” (Inquiry No.3039 of February 21, 2012). The MIC will swiftly revise the Regulations for Enforcement of the Telecommunications Business Act (Ministerial Ordinance of MPT No. 25 of 1985) based on this report.

1.Outline of draft ministerial ordinance

  The system of category II designated telecommunications facilities was established as an asymmetric regulation from a viewpoint of promoting fair competition and enhancing convenience of users by means of securing fairness and transparency of connection charges and rapid connections and of improving environments where smooth connections are allowed taking into account the risk that telecommunications carriers having the share higher than a certain level may cause discriminatory treatment in connections and prolongation of connection consultations based on their superiority in connection consultations. Specifically, the superiority in negotiations is granted to telecommunications carriers whose market share of specified mobile terminal facilities (hereinafter “terminal share”) is over 25% in service areas, and transmission line facilities connected to said specified mobile terminal facilities are designated as category II designated telecommunications facilities. In addition, telecommunications carriers that establish those facilities are imposed the rules for connections such as creation, publication and notification of interconnection tariff and putting of connection accounts in order.
  This partial revision of the Regulations for Enforcement of the Telecommunications Business Act is to revise the standard for designation of category II designated telecommunications facilities to over 10% of the terminal share.
 

2.Future plans

  The MIC will swiftly revise the Regulations for Enforcement of the Telecommunications Business Act based on this report.
