Appeal for Opinions on Formulation, etc. of Guidelines for Environmental Improvement for Promotion of Broadband Dissemination
Formulation and revision of guidelines based on the report from the Information and Communications Council titled “State of Environmental Improvement for Promotion of Broadband Dissemination”
The Ministry of Internal Affairs and Communications (MIC) has compiled draft “guidelines for smooth consultations among business operators” and a draft partial revision of “guidelines for application relationship between the Telecommunications Business Act and the Radio Act related to MVNO” in response to the report from the Information and Communications Council titled “State of Environmental Improvement for Promotion of Broadband Dissemination (December 20, 2011).
An appeal for opinions on these draft guidelines will be held from June 8 (Fri) to July 6 (Fri), 2012.
1.Outline
Among the matters related to environmental improvement for promotion of broadband dissemination indicated in the report from the Information and Communications Council titled “State of Environmental Improvement for Promotion of Broadband Dissemination (December 20, 2011),” the guidelines for improvement of transparency in consultations among business operators and clarification of reasons for refusal of connection will be formulated and revised based on the report.
1. Formulation of “guidelines for smooth consultations among business operators”
The report states that it is appropriate to make necessary efforts for sharing a way of thinking among business operators using the most transparent method by organizing the clarification of process of consultations among business operators, charging methods, range of hearing related to business plans, etc. from a perspective of smoother consultations among business operators. Therefore, new guidelines will be formulated based on the report.
2. Partial revision of “guidelines for application relationship between the Telecommunications Business Act and the Radio Act related to MVNO”
The report states that it is desirable to summarize accumulated interpretations in the past and to clarify reasons for refusal of connection in the guidelines for MVNO commercialization, etc. from a perspective of ensuring fair competition in the mobile market. Therefore, the guidelines will be revised based on the report.

The subjects of the appeal for opinions are as follows.
- Draft “guidelines for smooth consultations among business operators”
- Draft revision of “guidelines for application relationship between the Telecommunications Business Act and the Radio Act related to MVNO”
These draft guidelines will be posted in the column of “press release” on the MIC website (http://www.soumu.go.jp) and the column of “public comments” on the e-government portal (e-Gov) (http://www.e-gov.go.jp) and also distributed at the Tariff and Telecommunications Access Policy Division, Telecommunications Business Department, Telecommunications Bureau, MIC.
3.Future plans
The MIC will formulate and revise the guidelines based on results of the appeal for opinions.
