Appeal for Opinions on Draft Partial Revision of Notice related to Designation of Category II Designated Telecommunications Facilities based on the Provision of Article 34, Paragraph 1 of the Telecommunications Business Act
On September 4, 2012, the Information and Communications and Posts Administrative Council (Chairman: Atsushi Takahashi, Advisor to Sumitomo Mitsui Trust Bank) was consulted with the Minister for Internal Affairs and Communications about “designation of category II designated telecommunications facilities based on the provision of Article 34, Paragraph 1 of the Telecommunications Business Act.”
In line with this, an appeal for opinions on a draft partial revision of notice related to this designation will be held in the period from September 5 (Wed) to October 4 (Thu), 2012.
1.Outline, etc.
Concerning the system of category II designated telecommunications facilities, the Regulations for Enforcement of the Telecommunications Business Act was revised on June 19, 2012 in such a way that the occupation rate of specified mobile terminal facilities as a standard for designation of category II designated telecommunications facilities shall be “over 10%” in response to the report from the Information and Communications and Posts Administrative Council (May 29, 2012).
In response to this, a related notice will be partially revised to designate part of telecommunications facilities established by Softbank Mobile Corp., which has more than 10% of the occupation, as category II designated telecommunications facilities based on the provision of Article 34, Paragraph 1 of the Telecommunications Business Act.

Subject of appeal for opinions: “Comparative Table: Draft Notice for Partial Revision of the Notice of MIC No.72 of 2002 (Subject Designating Telecommunications Facilities for Ensuring Appropriate and Smooth Connections with Telecommunications Facilities with Other Telecommunications Carriers)
Deadline for appeal for opinions: October 4 (Thu), 2012, PM5:00 (must be arrive) (submissions by mail must also arrive by this date)
This draft designation will be posted in the column of “public comments” on the e-government portal (e-Gov) (http://www.e-gov.go.jp) and also distributed for reading at the General Affairs Division, Information and Communications Bureau, MIC, as soon as it is ready.
3.Future plans
The MIC will make investigations and deliberations based on opinions submitted on this draft notice and submit a report to the Minister for Internal Affairs and Communications.
