
Designation of Category II Designated Telecommunications Facilities based on the Provision of Article 34, Paragraph 1 of the Telecommunications Business Act
Report from the Information and Communications and Posts Administrative Council
On November 27, 2012, the Ministry of Internal Affairs and Communications (MIC) received a report from the Information and Communications and Posts Administrative Council (Chairman: Atsushi Takahashi) stating its approval of designation as inquired in response to an inquiry dated September 4, 2012 concerning the “designation of category II designated telecommunications facilities (hereinafter “category II designated facilities”) based on the provision of Article 34, Paragraph 1 of the Telecommunications Business Act (Act No.86 of 1984).
This report was made taking into account the results of the appeal for opinions held by the Council from September 5 to October 4, 2012 and the repeat appeal for opinions held from October 11 to October 24, 2012.
1.Background, etc.
The Regulations for Enforcement of the Telecommunications Business Act (Ministerial Ordinance of MPT No. 25 of 1985) was revised on June 19, 2012 in such a way that the occupation rate of specified mobile terminal facilities as a standard for designation of category II designated telecommunications facilities shall be “over 10%.” In response to this, a related notice will be partially revised to designate part of telecommunications facilities established by Softbank Mobile Corp., which has more than 10% of the occupation rate, as category II designated telecommunications facilities based on the provision of Article 34, Paragraph 1 of the Telecommunications Business Act.

The MIC will swiftly make a partial revision of the related notice based on this report.
