MPHPT announces results of invitation to comment on draft partial amendments of related cabinet order and ministerial ordinances in conjunction with the enforcement of Law for the Partial Amendment of the Radio Law and the Wire Telecommunications Law



The MPHPT prepared draft partial amendments of related cabinet order and ministerial ordinances in conjunction with the enforcement of the Law for the Partial Amendment of the Radio Law and the Wire Telecommunications Law (Law No. 47 of 2004), in order to implement the compensation scheme that was laid down by this law, and invited comments from May 27 until June 16. One comment was received as a result, and the MPHPT will move ahead with preparations for the announcement and enforcement of the draft cabinet order and ministerial ordinances.

1. Outline
Necessary amendments to the Law for the Partial Amendment of the Radio Law and the Wire Telecommunications Law were approved at the 159th session of the Diet, foundation of a compensation scheme for existing licensees who were arriving early at the expiration of their frequencies due to the prompt redistribution of frequencies, and these were announced on May 19, 2004.

Based on this law, swift radio spectrum reallocation will be implemented for the establishment of an environment that can use outdoor wireless LAN in the major metropolitan areas in 2005. Since the MPHPT plans to implement the business of paying out the necessary benefits in conjunction with this, it is carrying out the partial amendment of related cabinet order and ministerial ordinances.

2. Future Plans
The MPHPT will take the comments that were submitted at this time into consideration and will continue with its preparations for announcement and enforcement. It also plans to submit an inquiry to the Radio Regulatory Council, taking into consideration the comments, concerning the matters among the draft cabinet order and ministerial ordinances that require an inquiry to the council as specified in the Radio Law.
