Following its meeting today, the Radio Regulatory Council (Chair: Prof. HATORI Mitsutoshi, Faculty of Science and Engineering, Chuo University) reported to MIC that the draft MIC ordinance to partially amend the Essential Standards for Establishing Radio Stations Other Than Broadcast Stations is appropriate.
Meanwhile, from September 12 to October 15, 2007, MIC invited public comment on the draft MIC ordinance, and received five comments.
Considering the council report it received today, MIC will amend the Essential Standards for Establishing Radio Stations Other Than Broadcast Stations.
1. Background of the consultation
With a view to develop the establishment guidelines for specified radio stations using the 2.5 GHz band, MIC invited public comment on the draft establishment guidelines from May 15 until June 15, 2007. Some of the contributed comments point out the possibility that a person who establishes a specified base station of the establishment plan which is granted attestation (hereinafter called "attested establisher") may apply for a specified base station license by changing its organization or policy (e.g., by increasing the voting rights owned by a third-generation mobile phone operator from less than one-third to one-half of the total voting rights of the attested establisher) regardless of the establishment guidelines.
In consideration of the comments, and in order to take a measure to ensure that, after the establishment plan attestation, specified base stations are appropriately operated according to the purpose of the establishment guidelines for specified base stations (hereinafter called "establishment guidelines") stipulated in Article 27-12, paragraph 1 of the Radio Law (Law No. 131 of 1950), MIC intends to amend part of the Essential Standards for Establishing Radio Stations Other Than Broadcast Stations (Radio Regulatory Commission Rules No. 12 of 1950; hereinafter called the "Essential Standards").
2. Outline of the amendment
A provision that requires an attested establisher to establish a specified base station in accordance with the establishment guidelines for specified base stations is to be added to Article 3 of the Essential Standards.
3. Future schedule
MIC will promptly amend the Essential Standards, based on the council report.
