Registration Accompanying the Beginning of Business Concerning Broadband Mobile Wireless Access Systems in the Telecommunications Business Law

MIC approved a plan for establishing specified base stations for broadband mobile wireless access systems using the 2.5GHzgigahertz band in accordance with the provisions of Article 27-13 of the Radio Law (Law No. 131 of 1950) on December 21, 2007. In the registration (registration for change based on Article 13, Paragraph 1 of the Telecommunications Business Law (Law No. 86 of 1984, hereinafter referred to as "Business Law") for existing telecommunications carriers) based on the provisions of Article 9 of the Business Law, MIC shall set the terms and conditions based on Article 163, Paragraph 1 of the Business Law.

With regard to this, MIC has created a draft instruction to partially amend the Examination Standards Relating to the Telecommunications Business Law (MIC Instruction No. 75 of January 6, 2001), and now invites public comment thereon from today until Monday, January 28, 2008.

[Purpose and Outline]
1. MIC approved a plan for establishing specified base stations that use the 2.5 GHzgigahertz band frequencies in accordance with Article 27-13 of the Radio Law (hereinafter referred to as "establishment plan") on December 21, 2007.

All telecommunications carriers are now required to apply for registration of telecommunications business (registration for change based on Article 13, Paragraph 1 of the Telecommunications Business Law for existing telecommunications carriers) in accordance with the provisions of Article 9 of the Business Law and to be approved by the Minister for Internal Affairs and Communications prior to the inception of telecommunications business.

The telecommunications carrier approved as above is recognized to have a "plan to promote the use of radio facilities by telecommunication carriers who are not approved for establishment plans based on the establishment guidelines" as its plan for establishing specified base stations in accordance with the provisions of the Notice for Specifying the Guidelines for Establishing Specified Base Stations that Use the 2.5 GHzgigahertz Band Frequencies (MIC Notice No. 457 of 2007). In terms of the purpose of the Business Law, it is necessary that the plan be executed properly. MIC shall set such conditions as to secure the implementation of the plan in the registration.

2. With regard to this, MIC created a draft instruction to amend part of the Examination Standards Relating to the Telecommunications Business Law for examining registration applications. MIC therefore invites public comment thereon.
