Chapter 1 General Provisions

(Purpose)
Article 1   The purpose of this Ministerial Ordinance shall be to stipulate matters concerning technical conditions compliance approval for terminal equipment (hereinafter referred to as "approval") and the certification under Article 50-4 paragraph (1), Article 72-2 paragraph (1) and Article 72-3 paragraph (6) of the Telecommunications Business Law (hereinafter referred to as "the Law").
(Terms)
Article 2   The terms used in this ordinance are the same as terms used in the Law.
(Applicable Terminal Equipment)
Article 3   The assortment of terminal equipment stipulated in the applicable ordinance of the Ministry of Posts and Telecommunications under Article 50 paragraph (1) of the Law shall be as follows.
i)
Telephone sets, private branch exchanges, key telephones, modems, facsimiles, and other terminal equipment notified separately by the Minister of Posts and Telecommunications that is connected to telephone facilities (meaning telecommunication circuit facilities for telecommunications business, provided for telecommunications services whose main purpose is to transmit and exchange sound signals).
ii)
Terminal equipment connected to the radio paging facilities (meaning telecommunications circuit facilities for telecommunications business, provided for telecommunications services whose purpose is to make calls (including communications ancillary to the same) to users via radio signals).
iii)
Terminal equipment connected to Integrated Services Digital Network facilities (meaning telecommunications circuit facilities for telecommunications business, provided for telecommunications services whose main purpose is to comprehensively transmit and exchange correspondence, sound signals, and other sound or images at a transmission speed of 64 kilobits per second).
iv)
Terminal equipment connected to leased circuit facilities (meaning telecommunications circuit facilities for telecommunications business, provided for telecommunications services that provide the said equipment solely for specific users) or digital data transmission facilities (meaning telecommunications circuit facilities for telecommunications business, provided for telecommunications services whose purpose is solely to transmit and exchange code or images using digital methods).

Chapter 2 Technical Conditions Compliance Approval

(Application for Approval)
Article 4   A person who intends to obtain approval shall file with the Minister of Posts and Telecommunications or a designated approval agency, using the application stipulated in Attachment 1 accompanied by the documents stipulated in Attachment 2, for each equipment for which Approval is sought.
(Method etc. of Examination, etc.)
Article 5   The Minister of Posts and Telecommunications or a designated approval agency shall, when an application made in accordance with the preceding Article has arrived at its office, examine the documents submitted by the applicant to ascertain whether or not the terminal equipment to which the said application refers (hereinafter referred to as "the equipment under application") meets the technical conditions stipulated in the applicable ordinance of the Ministry of Posts and Telecommunications under Article 49 of the Law (hereinafter referred to as "the technical conditions").
2. If the Minister of Posts and Telecommunications or a designated approval agency, when making the examination under the preceding paragraph, is uncertain about any matters recorded in the documents and deeming it impossible to judge whether or not the Technical Conditions have been met from the submitted documents alone, request and examine additional documents, and, if still deeming it impossible to judge whether or not the Technical Conditions have been met from the documents alone, notify the applicant to this effect, and, subject to the wish of the applicant, shall receive submission of the Equipment Under Application and shall examine the said Equipment Under Application with respect to the matters deemed impossible to judge as set forth above.
3. The applicant may be present at the examination under the preceding paragraph.
(Notification of Result of Examination)
Article 6   If the Minister of Posts and Telecommunications or designated approval agency has, as a result of the examination, approved the equipment under application, it shall notify the applicant to this effect using a Certificate of Technical Conditions Compliance Approval, etc., in the format stipulated in Attachment 3, and shall make public notice of the following matters.
i)
Name or title of the person who has obtained the Approval
ii)
Name of the equipment
iii)
Approval number
iv)
Date of the Approval
2. If the Minister of Posts and Telecommunications or a designated approval agency, as a result of the examination, deems that the equipment under application does not meet the Technical Conditions, it shall notify the applicant to this effect in writing with specification as to the reason.
(Indication)
Article 7   The marking under Article 50 paragraph (4) of the Law shall be as stipulated in Attachment 5, and shall be attached in an easily visible location on the approved terminal equipment.
(Retrieval of Equipment)
Article 8   When an applicant has received the notification under Article 6 with respect to equipment under application submitted in accordance with the provisions of Article 5 paragraph (2), the applicant shall promptly retrieve the equipment under application.

Chapter 3 Certification of Assortment of terminal Equipment

(Certification of Assortment of terminal Equipment)
Article 9   The provisions of Articles 4 through the preceding Article shall apply, mutatis mutandis, to certification. In these case, "equipment for which Approval is sought" in Article 4 shall be read as "design pertaining to the said certification"; "whether or not the terminal equipment to which the said application refers (hereinafter referred to as "the equipment under application") meets the technical conditions stipulated in the applicable ordinance of the Ministry of Posts and Telecommunications under Article 49 of the Law (hereinafter referred to as "the technical conditions")" in Article 5 paragraph (1) shall be read as "whether or not the type to which the said application refers meets the technical conditions and whether or not it can be assured that all of the terminal equipment based on the type will be in conformity with the type"; "whether or not the technical conditions have been met" in Article 5 paragraph (2) shall be read as "whether or not the technical conditions have been met or whether or not it can be assured that all of the terminal equipment based on the type will be in conformity with the type"; "submission of the equipment under application" in the same paragraph shall be read as "submission of the terminal equipment based on the said design (hereinafter referred to as "the submitted equipment")"; "the said equipment under application" in the same paragraph shall be read as "the said submitted equipment"; "the said equipment under application" in Article 6 paragraph (1) shall be read as "the type to which the said application refers"; "Attachment 3" in the same paragraph shall be read as "attachment 4"; " terminal equipment" in the same paragraph shall be read as "terminal equipment based on the said type"; "Approval number" in the same paragraph shall be read as "Certification number"; "Date of the approval" in the same paragraph shall be read as "Date of the certification"; "deemed that the equipment under application does not meet the technical conditions" in Article 6 paragraph (2) shall be read as "the design to which the said application refers does not meet the technical conditions or that it cannot be assured that all of the terminal equipment based on the type will be in conformity with the type"; "Article 50 paragraph (4) of the Law" in Article 7 shall be read as "Article 50-4 paragraph (5) of the Law"; "that has been approved" in the same Article shall be read as "based on the design to which the certification refers"; "equipment under application submitted in accordance with the provisions of Article 5 paragraph (2)" in Article 8 shall be read as "submitted equipment in accordance with the provisions of Article 5 paragraph (2) as applied, mutatis mutandis, to Article 9"; "Article 6" in the same Article shall be read as "Article 6 as applied, mutatis mutandis, to Article 9"; and "shall promptly retrieve the equipment under application" in the same Article shall be read as "shall promptly retrieve all the Submitted Equipment".

Chapter 4 Designated Approval Agencies

(Classes of Designation)
Article 10   The classes stipulated in the applicable ordinance of the Ministry of Posts and Telecommunications under Article 68 paragraph (2) of the Law (hereinafter referred to as "classes") shall be as follows.
i)
Terminal equipment for the purpose of calls
ii)
Terminal equipment except the preceding item
(Application for Designation)
Article 11   A person who intends to obtain designation under the provisions of Article 68 paragraph (2) of the Law (hereinafter referred to as "designation") shall submit an application containing the following matters to the Minister of Posts and Telecommunications.
i)
The classes intended to be approved.
ii)
Name and address.
iii)
Name and address of the office where the work of approval, or the work of approval and certification intended to be executed.
iv)
Date on which the work of approval, or the work of approval and certification is intended to be started.
2. The application under the preceding paragraph shall be accompanied by the following documents.
i)
Articles of association or an act of endowment, and a copy of the register
ii)
A list of assets and a balance sheet for the business year preceding the business year in which the date of the application falls, provided however that, for juridical persons established in the business year in which the date of the application falls, this shall be the list of assets at the time of establishment
iii)
The business plan and revenue and expenditure budget for the business year in which the date of the application falls and for the following business year
iv)
Documents certifying the decision of intention with respect to the application for designation
v)
Documents containing the names and career of officers
vi)
Documents containing matters concerning organization and operation
vii)
Documents containing an outline and preparing plan of measuring instruments and other equipment used for examination in each office intending to execute the work of approval, or the work of approval and certification, and plans for the development thereof
viii)
Documents containing a plan concerning the method of executing the appointment of the approval examiner under the provisions of Article 71 paragraph (2) of the Law (hereinafter referred to as "approval examiner")
ix)
Documents containing plans concerning the method of carrying out the work of Approval, etc.
x)
Documents containing matters which can be instructive
(Notification of Changes in the Name, etc., of a Designated Approval Agency)
Article 12   A designated approval agency shall, when intending to make the notification under the provisions of Article 70 paragraph (2) of the Law, submit to the Minister of Posts and Telecommunications a notification containing the following matters.
i)
The name or address or location following the change
ii)
Date on which the change intended to be made
(Qualification of Approval Examiner)
Article 13   The qualifications stipulated in the applicable ordinance of the Ministry of Posts and Telecommunications under Article 71 paragraph (2) of the Law shall be that one of the following shall be satisfied.
i)
One who has graduated from a university under the School Education Law (1947 Law No. 26) (excluding junior colleges; the same shall apply in item iii)) or a university under the former University Act (1918 Edict No. 388), as satisfactory having mastered such subjects related to electricity or telecommunication, or who has been issued with a chief telecommunications engineer's qualification certificate, and who has at least one year's experience employment in the work of approval or certification, or examination, adjustment or maintenance of terminal equipment (hereinafter referred to as "work experience")
ii)
One who has graduated from a junior college university or vocational high school under the School Education Law or a vocational school under the former Vocational School Act (1901 Edict No. 61), as satisfactory having mastered such subjects related to electricity or telecommunication, or who is an installation technician (excluding persons who are analog type III installation technicians or digital type III installation technicians), and who has at least three years' work experience
iii)
One who has graduated from an overseas school equivalent to a university as satisfactory having mustered such subjects related to electricity or telecommunication, and who has at least one year's work experience
iv)
One who has graduated from an overseas school equivalent to a junior college or a vocational high school, as satisfactory having mastered such subjects related to electricity or telecommunication, and who has at least three years' work experience
v)
One whom the Minister of Posts and Telecommunications recognizes as having knowledge and experience not less than the persons referred to in any of the preceding four items
(Applications for Authorization of Appointment and Dismissal of Officers)
Article 14   A designated approval agency shall, when intending to obtain the authorization under Article 73 of the Law to which Article 59 paragraph (1) of the Law shall apply, mutatis mutandis, submit an application containing the following matters to the Minister of Posts and Telecommunications.
i)
Name of the person to be appointed as an officer or of the officer to be dismissed
ii)
Reason for the appointment or dismissal
iii)
In the case of appointment, the career of the person
2. In the case of the preceding paragraph, when intending to obtain authorization for appointment, the application under the same paragraph shall be accompanied by a letter of acceptance relating to the said appointment.
(Notification of Appointment and Dismissal of Approval Examiners)
Article 15   A designated approval agency shall, when intending to submit the notification under Article 72 of the Law to which Article 59 paragraph (2) of the Law shall apply, mutatis mutandis, submit a notification containing the following matters to the Minister of Posts and Telecommunications.
i)
Name of the approval examiner
ii)
Reason for the appointment or dismissal
iii)
In the case of appointment, the career of the person, and the name and location of the office where the person executes the work of approval and certification
2. In the case of the preceding paragraph, when intending to submit a notification of appointment, the notification under the said paragraph shall be accompanied by copies of documents certifying that the person to whom the said appointment pertains is equipped with the qualifications for approval examiners under Article 13.
(Mentioned Items of Business Rules)
Article 16   Matters stipulated in the applicable ordinance of the Ministry of Posts and Telecommunications under Article 72 of the Law to which Article 61 paragraph (1) of the Law shall apply, mutatis mutandis, are as follows.
i)
Matters concerning hours for executing the work of approval and certification, and holiday
ii)
Matters concerning the office for executing the work of approval and certification
iii)
Matters concerning the method of executing the work of Approval, etc.
iv)
Matters concerning the method of collecting fees
v)
Matters concerning the appointment, dismissal, and allocation of approval examiners
vi)
Matters concerning the service oaths of approval examiners
vii)
Matters concerning the maintenance of secrecy concerning the work of approval and certification
viii)
Matters concerning the management of record books and documents concerning the work of approval and certification
ix)
Other necessary matters concerning the execution of the work of approval and certification
(Application for Authorization of Business Rules)
Article 17   A designated approval agency shall, when intending to obtain authorization under Article 72 of the Law to which the provisions of the first clause of Article 61 paragraph (1) of the Law shall apply, mutatis mutandis, submit an application accompanied by the business rules pertaining to the said authorization to the Minister of Posts and Telecommunications.
2. A designated approval agency shall, when intending to obtain authorization under Article 72 of the Law to which the provisions of the second clause of Article 61 paragraph (1) of the Law shall apply, mutatis mutandis, submit an application containing the following matters to the Minister of Posts and Telecommunications.
i)
Matters to be changed
ii)
Data when the change intended to be made
iii)
Reason for change.
(Application for Authorization of Business Programs, etc.)
Article 18   A designated approval agency shall, when intending to obtain authorization under Article 72 of the Law to which the provisions of the first clause of Article 62 paragraph (1) of the Law shall apply, mutatis mutandis, submit an application accompanied by the business program and revenue and expenditure budget pertaining to the said authorization to the Minister of Posts and Telecommunications.
2. A designated approval agency shall, when intending to obtain authorization under Article 72 of the Law to which the provisions of the second clause of Article 62 paragraph (1) of the Law shall apply, mutatis mutandis, submit an application containing matters that is to be changed and the reason for the proposed changes to the Minister of Posts and Telecommunications.
(Record Books)
Article 19   The matters stipulated in the applicable ordinance of the Ministry of Posts and Telecommunications under Article 72 of the Law to which Article 63 of the Law shall apply, mutatis mutandis, are as follows.
i)
Name of the applicant
ii)
Date of receipt of the application
iii)
Classes
iv)
Name of the terminal equipment
v)
Result of the examination
vi)
The approval number, etc. (meaning a symbol attached to the indication stipulated in attachment 5, and an approval number or a certification number ) and the date on which the approval or certification is executed
2. The record book under Article 72 of the Law to which Article 63 of the Law shall apply, mutatis mutandis, shall be formulated and kept for each office where the work of approval and certification is executed and shall be retained for ten years from the date of entry.
3. The retention under the preceding paragraph may be undertaken recording media that to be recorded by electro-magnetic methods (meaning an electronic method, a magnetic method, or other method that may not be recognized by human perception).
(Application for Permission of Suspension and Discontinuation of the work of approval, or the work of approval and certification)
Article 20   A designated approval agency shall, when intending to obtain the permission under Article 72 of the Law to which Article 65 paragraph (1) of the Law shall apply, mutatis mutandis, submit an application containing the following matters to the Minister of Posts and Telecommunications.
i)
Scope of the work of approval, or the work of approval and certification that the suspended or the discontinuation is intended to be done
ii)
Date when the suspension or discontinuation is intended to be done, and in case of suspension, the duration thereof
iii) Reason for the suspension or discontinuation
(Succession of the Work of Approval, and the work of approval and certification)
Article 21   A designated approval agency shall, in the cases under Article 72 of the Law to which Article 67 paragraph (3) of the Law shall apply, mutatis mutandis, undertake the following matters.
i)
Succession of whole or a part of the work of approval, or whole or a part of approval and certification to the Minister of Posts and Telecommunications
ii)
Succession of the record books and documents concerning whole or a part of the work of approval, or concerning whole or a part of the work of approval and certification to the Minister of Posts and Telecommunications
iii)
Other matters deemed necessary by the Minister of Posts and Telecommunications
(Public Notice)
Article 22   The public notice under Article 72 of the Law to which Article 65 paragraph (2) of the Law, Article 66 paragraph (3) of the Law, Article 67 paragraph (2) of the Law, and Article 70 paragraphs (1) and (3) of the Law shall apply, mutatis mutandis, shall be carried out by notification in Ministerial Bulletins.

Chapter 5 Recognized Approval Bodies

(Application for Recognition)
Article 23   The application in Article 72-3 paragraph (1) of the Law shall be made by submitting an application containing the following matters to the Minister of Posts and Telecommunications, however that this shall not apply if application is made in a way otherwise notified by the Minister of Posts and Telecommunications.
i)
Classes intended to be approved
ii)
Name and address
iii)
Name and location of the office where the work of approval, or the work of approval and certification intended to be executed
iv)
Date when the work of approval, or the work of approval and certification is intended to be started.
2. The application under the preceding paragraph shall be accompanied by the following documents.
i)
Articles of association or an act of endowment, and a copy of the company register, or the equivalent of these
ii)
A list of assets and a balance sheet for the business year preceding the business year in which the date of the application falls, and other documents that clearly prove the existence of an accounting basis (hereinafter referred to as "List of Assets etc."), provided however that, for juridical persons established in the business year in which the date of the application falls, this shall be the list of assets etc., at the time of establishment
iii)
Documents certifying the decision of intention with respect to the application
iv)
Documents containing matters concerning organization and operation
v)
Documents containing an outline and a preparing plan of measuring instruments and other equipment, used for each office at where examination for the work of approval, or the work of approval and certification intended to be executed
vi)
Documents showing that the applicant is a person who executes inspections, examinations, etc. (hereinafter referred to as "foreign inspection etc") of terminal equipment based on a system concerning the inspection of terminal equipment based on laws and ordinances in a foreign country and which in similar to the system of technical conditions compliance approval (hereinafter referred to as "foreign inspection system")
vii)
Documents containing an outline of the foreign inspection system
viii)
Documents containing an outline of the work of foreign inspection etc., currently carried out
ix)
Documents containing a plan covering the method of execution of the work of approval, or the work of approval and certification.
x)
Documents containing the matters concerning the appointment of an approved examiner with the qualifications stipulated in the applicable ordinance of the Ministry of Posts and Telecommunications under Article 72-3 paragraph (2) of the Law to which Article 71 paragraph (2) of the Law shall apply, mutatis mutandis, (in the case, it applied to Article 72-3 paragraph (7) is included) (hereinafter referred to as "foreign approval examiner")
xi)
Documents containing other matters which can be instructive
(Provisions Applicable Mutatis Mutandis)
Article 24   The provisions of Articles 4 through 9 shall apply, mutatis mutandis, to approval and certification executed by recognized approval bodies, and the provisions of Articles 12, 13, 16, 17, 19 and 22 shall apply, mutatis mutandis, to recognized approval bodies. In these cases, "Article 70 paragraph (2) of the Law" in Article 12 shall be read as "Article 70 paragraph (2) of the Law to which Article 72-3 paragraph (5) of the Law shall apply, mutatis mutandis"; "approval examiner" in Articles 13 and 16 shall be read as "foreign approval examiner"; "Article 72 of the Law" in Article 16 and 17 shall be read as "Article 72-3 paragraph (5) "; "Article 72 of the Law" in Article 19 shall be read as "Article 72-3 paragraph (7) of the Law to which paragraph (5) of the same Article shall apply"; and "Article 72 of the Law to which Article 65 paragraph (2) of the Law, Article 66 paragraph (3) of the Law and Article 67 paragraph (2) of the Law, and Article 70 paragraphs (1) and (3) of the Law shall apply, mutatis mutandis, to Article 72 of the Law" in Article 22 shall be read as "Article 72-3 paragraph (4) of the Law and Article 72-3 paragraph (5) of the Law to which Article 70 paragraphs (1) and (2) of the Law shall apply, mutatis mutandis".

Supplementary Provisions

(Date of Enforcement)
1. This Ministerial Ordinance shall come into force as from the day of enforcement of the provisions set force in Article 1 item iii) of the supplementary provisions to the Law on improvement etc. of related legislation aimed at rationalizing restrictions in the telecommunications sector (1998 Law No. 58).
(Repeal of Ordinance Concerning Technical Conditions Compliance Approval for Terminal Equipment)
2. The Ordinance Concerning Technical Conditions Compliance Approval for Terminal Equipment (Ordinance of the Ministry of Posts and Telecommunications No. 29 of 1985; hereinafter referred to as "the former ordinance") shall be repealed.
(Transitional Measures)
3. Examinations, notifications, and other procedures concerning terminal equipment for which application has been made on the basis of the former ordinance as of the time of enforcement of this Ministerial Ordinance shall follow the example of precedence.
4. The indications stipulated in attachment 4 of the former ordinance shall be interpreted as the indications stipulated in attachment 5 of this Ministerial Ordinance.

    1. When applying to a designated approval agency, the addressee should be that designated approval agency, and when applying to an recognized approval body, the addressee should be that recognized approval body.

    3. Address should be described, a place of residence in case of an individual, or a head office or main office in case of a juridical person or an association.
    4. Method of description is as follows.
      (1)
      If the name is signed in person, the seal may be omitted.
      (2)
      Juridical persons or associations should give their firm name or title, and the name and position of their representative, and should use the seal of the representative. However, if the name is signed by the representative, the seal may be omitted.
    5. Erase unnecessary characters.
    6. Please use the remarks box to give any matters that may be required, e.g. a partial change to terminal equipment that has already been certified.
    7. Designated approval agency or recognized approval body may change this form partially to the extent of necessary to make the work more efficiently.

    Examination data, regardless of whether obtained by the applicant executing examination in person or entrusting the examinations to a test laboratory, should have been obtained using a examination method designated by the technical conditions, or, if no examination method has been designated, by a rational examination method.
    Moreover, if the applicant has entrusted the examinations to an attested examiner etc., a certification of the examination results by the said attested examiner etc. should also be submitted as examination data.

Attachment 5 The matters to be indicated shall be the following indication and a symbol attached to the indication, and the approval number or certification number.(related to Articles 7, 9 and 24)
Note
  1. The size shall be at least 5 millimeters in diameter (or, in the case of terminal equipment with a volume of 100cc or less, at least 3 millimeters in diameter).
  2. The material shall be one which is not easily damaged.
  3. The color shall be as appropriate. However, the mark shall be easily distinguishable.
  4. The symbols attached to the indication shall be "A" and "T", respectively, for cases of technical conditions compliance approval and certification of the type of terminal equipment.
  5. The first letter of the approval number or certification number shall be under the following table in accordance with the class of terminal equipment. Other letters shall be those notified separately by the Minister of Posts and Telecommunications and those stipulated by designated approval agencies or recognized approval bodies. Moreover, when technical conditions compliance approval or certification has been executed simultaneously for two or more type of terminal equipment which form a single unit in view of their structure, the said type of terminal equipment shall be marked with a series of symbols given in the following table.

Notification No. 164 of the Ministry of Posts and Telecommunications, 1999

     Under the provisions of Article 3 of the Ordinance Concerning Technical Conditions Compliance Approval and Certification of the Type of terminal Equipment (Ministerial Ordinance No. 14 of the Ministry of Posts and Telecommunications, 1999), types of terminal equipment subject to technical conditions compliance approval and certification of the type are stipulated as follows.

     Notification No. 234 of the Ministry of Posts and Telecommunications (Matters for Stipulating Terminal Equipment Subject to Technical Conditions Compliance Approval), 1985, is hereby repealed.

In accordance with indication of terminal equipment, indication of characters set forth item i) through iii) is done in order each item.
i)
The year in which the application for technical conditions compliance approval or certification of the type of terminal equipment was received by the designated approval agency or recognized approval body executing the said approval and certification (hereinafter referred to as "certification agency") (the last two digits of the western calendar year)
ii)
The serial number for applications received by the certification agency in the said year with respect to technical conditions compliance approval and certification of the type of terminal equipment (four digits)
iii)
The identifying code of the Verifying Agency
