In conjunction with the enforcement of the Act for Partial Revision of the Act on Identification, Etc. by Mobile Voice Communications Carriers of their Subscribers, Etc. and for Prevention of Improper Use of Mobile Voice Communications Services (Act No. 76 of 2008; hereinafter, "Revised Act for Prevention of Improper Use of Mobile Phones"), the Ministry of Internal Affairs and Communications (MIC) has developed a draft MIC Ordinance for Partial Revision of the Ordinance for Enforcement of the Act on Identification, Etc. by Mobile Voice Communications Carriers of their Subscribers, Etc. and for Prevention of Improper Use of Mobile Voice Communications Services (MIC Ordinance No. 167 of 2005) (hereinafter, "draft MIC ordinance").
MIC hereby invites public comment on the draft MIC ordinance until Thursday, September 25, 2008.
Background to the revision
In light of the recent occurrences of so-called "bank transfer scams," MIC drafted the Revised Act for Prevention of Improper Use of Mobile Phones to prevent improper use of mobile voice communications services. The revised act imposes similar regulations on SIM (subscriber identity module) cards as those on mobile phone terminals. It also requires mobile phone terminal lenders to confirm user identification more strictly upon lending terminals and to create and maintain records of such identification. The Revised Act for Prevention of Improper Use of Mobile Phones was enacted at the Upper House plenary session on June 11, 2008, and promulgated on June 18.
As the Revised Act for Prevention of Improper Use of Mobile Phones must be enforced within six months from the date of promulgation, MIC prepared the draft MIC ordinance to develop necessary provisions for the matters delegated to MIC ordinances in the revised act.
