October 12, 2020 Results of Appeal for Opinions on Draft Ministerial Ordinance and Notice for Partial Revisions to the Regulations for Enforcement of the Radio Act and the Ordinance Regulating Radio Equipment along with Report from the Radio Regulatory Council

Reflection of the revision of Annex 10 of the International Civil Aviation Convention in domestic technical standards

The Ministry of Internal Affairs and Communications (MIC) made an appeal for opinions from Thursday, September 10 through Friday, October 9, 2020, on a ministerial ordinance and relevant notice drafted to partially revise the Ordinance Regulating Radio Equipment (Radio Regulatory Commission Rules No. 18 of 1950). However, no opinions were submitted in response to this matter.
MIC submitted an inquiry today about the drafted revision of the ministerial ordinance and relevant notice to partially revise the Ordinance Regulating Radio Equipment to the Radio Regulatory Council (Chaired by YOSHIDA Susumu, Professor Emeritus, Kyoto University). In response to the inquiry, MIC has received a report stating its approval as drafted.
Considering the results of the appeal for opinions and the report from the Radio Regulatory Council, MIC will promptly make institutional development.

1. Background and overview

Aviation radio communication is effectively used as an indispensable means of communication to ensure the safe operation of aircraft. The International Civil Aviation Organization (ICAO) recently revised the 10th Annex of the International Civil Aviation Convention (hereafter referred to as the “ICAO Convention”). In this connection, MIC received a report on September 8, 2020, from the Information and Communications Council on issues and countermeasures for establishing domestic technical standards concerning the reflection of the revision of Annex 10 of the International Civil Aviation Convention in domestic technical standards.

With consideration of this report, MIC decided to revise the relevant ministerial ordinance, etc. partially to reflect the revised contents of the ICAO Convention Annex 10 in the domestic technical requirements. Accordingly, MIC made the appeal for opinions from Thursday, September 10 through Friday, October 9, 2020, on a ministerial ordinance and relevant notice drafted to revise the Ordinance Regulating Radio Equipment partially.

2. Subject of appeal for opinions and guidelines therefor

  • Draft Ministerial Ordinance for Partial Revision of the Ordinance Regulating Radio Equipment
  • Draft Notice to Revise MPT Notice No. 341 of 1970 (determining the technical requirements for the particular calling devices of radiotelephone stations for mobile aviation services under the provisions of Article 9-2, Paragraph 2 of the Ordinance Regulating Radio Equipment)

3. Result of appeal for opinions

No opinions were submitted in response to the draft ministerial ordinance and relevant notice.

4. Report from the Radio Regulatory Council

Considering the results of the appeal for opinions, MIC submitted the inquiry about the drafted revision of the ministerial ordinance and relevant notice to partially revise the Ordinance Regulating Radio Equipment to the Radio Regulatory Council. In response to the inquiry, MIC has received the report stating its approval as drafted.

5. Future plans

Considering the results of the appeal for opinions and the report from the Radio Regulatory Council, MIC will promptly make institutional development for the ministerial ordinance and relevant notice on November 5 (the date the revised 10th Annex of the ICAO Convention will come into effect).
