February 18, 2020 Appeal for Opinions on Draft Ministerial Ordinance for Partial Revision of Ordinance Concerning Technical Regulations Conformity Certification of Specified Radio Equipment

Establishment of a system for clarifying the range of radio wave emission in technical standard conformity certification

With consideration of the additional proposals of the fiscal 2019 follow-up meeting of a growth strategy roundtable meeting on the effective use of radio waves (hereinafter referred to as “the follow-up meeting”), the Ministry of Internal Affairs and Communications (MIC) has drafted a ministerial ordinance for the partial revision of the ordinance concerning technical regulations specified radio equipment.
Accordingly, MIC has decided to make an appeal for opinions on the draft ministerial ordinance from Wednesday, February 19 through Thursday, March 19, 2020.

1. Background

In recent years, radio equipment, as Wi-Fi, on the premise of obtaining technical standards have been widely spreading. However, there have been cases where wireless equipment that does not conform to technical standards or wireless equipment that has acquired technical standard conformity certification for only some functions and has not acquired other functions are sold.
Such radio equipment could cause interference with other radio stations if it is purchased and misused by ordinary consumers without expertise. Furthermore, consumers may be disadvantaged, e.g., they may not be able to use such equipment properly under the Radio Act, even though they have purchased to use it.
In response to these, MIC has drafted a ministerial ordinance for the partial revision of the ordinance concerning technical regulations specified radio equipment (Ministerial Ordinance of MPT No. 37 of 1981). This draft specifies that the applicant shall indicate that no radio waves will be emitted outside the application range when applying for the technical regulations conformity certification of specified radio equipment. Therefore, MIC has decided to make an appeal for opinions on the draft ministry ordinance.
