August 31, 2020 Establishment of Ministerial Ordinance for Partial Revision to Ordinance for Specifying Identity Information of the Sender of Article 4, Paragraph 1 of the Act on Restrictions on the Liability for Damages of Specified Telecommunications Service Providers and the Right to Demand Disclosure of Identity Information of the Sender

With consideration of the recommendations of the Study Group on Ideal State of Disclosing Sender Information (chaired by SOGABE Masahiro, professor at Graduate School of Law, Kyoto University), the Ministry of Internal Affairs and Communications made a partial revision to the Ordinance for Specifying Identity Information of the Sender as per Article 4, Paragraph 1 of the Act on Restrictions on the Liability for Damages of Specified Telecommunications Service Providers and the Right to Demand Disclosure of Identity Information of the Sender. Accordingly, MIC promulgated and enforced the revision today.

Based on the Act on Restrictions on the Liability for Damages of Specified Telecommunications Service Providers and the Right to Demand Disclosure of Identity Information of the Sender (Act No. 137 of 2001) (hereafter referred to as “Provider Liability Limitation Act”), MIC established the Ordinance for Specifying Identity Information of the Sender of Article 4, Paragraph 1 of the Act on Restrictions on the Liability for Damages of Specified Telecommunications Service Providers and the Right to Demand Disclosure of Identity Information of the Sender (Ministerial Ordinance of MPHPT No. 57 of 2002) in 2002.
The interim report (August 2020) of the Study Group on Ideal State of Disclosing Sender Information stated the appropriateness of a revision to the ordinance to add the Provider Liability Limitation Act with telephone numbers as a disclosure subject. In response to the report, the ordinance (Revised Ministerial Ordinance No. 3) has been added with callers’ telephone numbers as a subject of disclosure related to the infringement of the rights to be protected under the ordinance and promulgated and enforced today.
