October 19, 2021 Appeal for Opinions on Draft Ministerial Ordinance and Relevant Conditions for Partial Revisions to Regulations for Enforcement of the Telecommunications Business Act

Considering the fifth report of a Study Group on Calculation of Interconnection Charges, released on September 10, 2021, the Ministry of Internal Affairs and Communications (MIC) has drafted a ministerial ordinance to partially revise the Regulations for Enforcement of the Telecommunications Business Act.
In this connection, MIC will make an appeal for opinions from Wednesday, October 20 through Thursday, November 18, 2021.

1. Background

The fifth report of the Study Group on Calculation of Interconnection Charges, released on September 20, 2021, states that it is appropriate to demand telecommunications carriers submit the details and specific values of the calculation method of interconnection charges supporting calculation references to MIC. In addition, there is a need to review the calculation method for β. Accordingly, MIC has decided to make institutional development, including partial revisions to the Regulations for Enforcement of the Telecommunications Business Act (Ministerial Ordinance of MPT No. 25 of 1985).

2. Appeal for opinions

1. Subject

  • Draft Ministerial Ordinance for Partial Revisions to the Regulations for Enforcement of the Telecommunications Business Act
  • Draft Notice for Partial Revisions to MIC Notice No. 110 of 2016 (Matters specifying the values to be used in the calculation of interconnection charges based on the provisions of Article 8, Paragraph 9 of the Interconnection Tariff Relating to Category II Designated Telecommunications Facilities)
  • Draft Notice for Partial Revisions to MIC Notice No. 37 of 2017 (Matters prescribing forms pursuant to Article 23-9-3 of the Regulations for Enforcement of the Telecommunications Business Act)
  • Draft Revisions to the Guidelines on Application of the Telecommunications Business Act and Radio Act related to MVNO (formulated in June 2002)

2. Submission period:

From Wednesday, October 20 and no later than Thursday, November 18, 2021
(Submission of opinions by postal mail must also arrive no later than the deadline date.)

3. Future plans

MIC will promptly promulgate and enforce the revisions based on opinions received.
