November 19, 2021 Appeal for Opinions on Draft Ministerial Ordinance to Partially Revise Regulations for Enforcement of the Telecommunications Business Act

The Information and Communications and Posts Administrative Council was consulted today by the Minister for Internal Affairs and Communications on a draft ministerial ordinance to partially revise the Regulations for Enforcement of the Telecommunications Business Act and pertinent conditions.
In this connection, an appeal for opinions will be made on the draft ministerial ordinance from Saturday, November 20 through Monday, December 20, 2021.

1. Overview

The Act on Partial Amendments to the Telecommunications Business Act (Act No. 5 of 2019) came into effect in October 2019. The draft revisions cover contracts that were concluded under the Regulations for Enforcement of the Telecommunications Business Act (Ministerial Ordinance of MPT No. 25 of 1985) prior to the enforcement of the revised Telecommunications Business Act (Act No. 86 of 1984) and do not conform to Article 27-3, paragraph 2, item 2 of the revised Telecommunications Business Act.

    Concerning the special exceptions for the partial modification of the said contracts, a provision shall be added to allow changes to be made to the contract conditions that do not conform to Article 27-3, paragraph 2, item 2 of the revised Telecommunications Business Act.
  • 2.
    Concerning the special exceptions for renewing the said contracts, a provision shall be added to clarify a policy to abolish the said special exceptions by the end of 2023. These revisions will eliminate the discrepancy in the said contracts as soon as possible.

From Saturday, November 20 and no later than Monday, December 20, 2021
(Opinions, if submitted by postal mail, must arrive no later than the deadline date.)

3. Future plans

Considering the results of the appeal for opinions, the Information and Communications and Posts Administrative Council will deliberate the matter and make a report to the Minister for Internal Affairs and Communications.
