December 24, 2021 Results of Appeal for Opinions on Draft Ministerial Ordinance and Relevant Conditions for Partial Revisions to Regulations for Enforcement of the Telecommunications Business Act and Revision of Guidelines on Application of the Telecommunications Business Act and Radio Act related to MVNO

The Ministry of Internal Affairs and Communications (MIC) made an appeal for opinions from Wednesday, October 20 through Thursday, November 18, 2021 on a draft ministerial ordinance and relevant conditions for partial revisions to the Regulations for Enforcement of the Telecommunications Business Act. As a result, five opinions were submitted. Accordingly, MIC has decided to open the opinions to the public, along with MIC’s view on the opinions and the revised Guidelines on Application of the Telecommunications Business Act and Radio Act related to MVNO (originally formulated in June 2002).

1. Overview

The fifth report of the Study Group on Calculation of Interconnection Charges, released on September 10, 2021, provided a telecommunication-related review. This review includes a recommendation stating that it is appropriate to demand telecommunications carriers submit the details and specific values of the calculation method of mobile connection charges, including the basis for calculation, to MIC. In this regard, the Regulations for Enforcement of the Telecommunications Business Act (Ministerial Ordinance of MPT No. 25 of 1985) and relevant conditions are to be revised.

2. Results of appeal for opinions

MIC drafted the ministerial ordinance etc. for partial revisions to the Regulations for Enforcement of the Telecommunications Business Act and relevant conditions and appealed for opinions from Wednesday, October 20 through Thursday, November 18, 2021 for the drafts following the Administrative Procedure Act (Act No. 88 of 1993).
As a result, five opinions were submitted.

3. Promulgation of MIC Ordinance, etc.

Considering the results of the appeal for opinions, MIC has today promulgated the following Ordinance and Notices and revised the Guidelines.

• Ministerial Ordinance for Partial Revisions to the Regulations for Enforcement of the Telecommunications Business Act
• Notice for Partial Revisions to MIC Notice No. 110 of 2016 (Matters specifying the values to be used in the calculation of interconnection charges)
• Notice for Partial Revisions to MIC Notice No. 37 of 2017 (Matters prescribing forms following the provisions of Article 23-9-3 paragraph 1 of the Regulations for Enforcement of the Telecommunications Business Act)
• Revisions to the Guidelines on Application of the Telecommunications Business Act and Radio Act related to MVNO (Attachment 5P)
