March 30, 2021 Result of Appeal for Opinions on Draft Partial Revision of Notice related to Designation of Specified Telecommunications Facilities based on Telecommunications Business Act and Partial Revision of Said Notice

The Ministry of Internal Affairs and Communications (MIC) made an appeal for opinions from Saturday, January 30 through Monday, March 1, 2021, on a partial amendment to the Notice on the designation of specific telecommunications facilities based on the Telecommunications Business Act (Law No. 86 of 1984). As a result, one opinion was submitted. Accordingly, MIC has decided to open the opinion to the public with MIC’s view on the opinion.

1. Overview

Under the Telecommunications Business Act, if a licensee or a licensed group company of a category I or II designated facility merges with another licensee of a specified telecommunications facility, a renewal of the telecommunications business registration is required under Article 2, from the perspective of promoting fair competition.
MIC’s Notice to partially revise MIC Notice No. 243 of 2001 (Designating Telecommunications Equipment Based on the Provisions of Article 33, Paragraph 1 of the Telecommunications Business Act and Article 23-2, Paragraph 1 of the Regulations for Enforcement of the Telecommunications Business Act) was promulgated on January 14, 2021. Furthermore, for the designation and cancellation of specified telecommunications facilities based on the installation status of facilities in 2019, this amendment will partially revise the Notice.

This notice has been promulgated today and will come into force on April 1, 2021.
