April 20, 2021 Administrative Guidance to NTT-Neomeit Corporation regarding Thorough Notification of Changes related to the Accredited Business Operator handling Electronic Power of Attorney

The Ministry of Internal Affairs and Communications (MIC) and the Ministry of Economy, Trade and Industry (METI) have today provided administrative guidance to NTT-Neomeit Corporation (headed by KISHIMOTO Teruyuki, President and Representative Director), the accredited business operator handling electronic power of attorney, to implement measures to prevent the recurrence and make improvements thoroughly. The reason is that NTT-Neomeit Corporation failed to notify MIC and METI of the change of its representative required by law.

Outline of the case and content of administrative guidance

MIC and METI grant accreditations based on Article 5, paragraph 1 of the Act on Promotion of Dissemination of Electronic Power of Attorney (Act No. 64 of 2017) to those who handle electronic power of attorney as accredited business operators handling electronic power of attorney.
Under the provisions of Article 8, Paragraph 3 of the Act, accredited business operators handling electronic power of attorney shall notify the competent ministers to that matters without delay when there is a change in the representative. However, it was confirmed that NTT-Neomeit Corporation failed to notify MIC and METI despite the change in the representative in June of 2019.
In light of the Act, it is clear that NTT-Neomeit Corporation had to report the change in the representative without delay. Nevertheless, NTT-Neomeit Corporation neglected the necessary confirmation and did not submit a notification of the change, whereby its negligence was admitted. Therefore, today, MIC and METI have instructed the company to implement measures to prevent recurrence and make improvements thoroughly.
MIC and METI will continue to strive for strict enforcement of the Act to promote electronic commerce and other economic activities using advanced information and communication networks through the promotion of electronic contracts.
