July 14, 2021 Results of Appeal for Opinions on Draft Ministerial Ordinance etc. for Partial Revision of the Regulations for Enforcement of the Radio Act and Report from the Radio Regulatory Council

Institutional development related to frequency band expansion for outdoor use of microwave UWB wireless system

The Ministry of Internal Affairs and Communications (MIC) made an appeal for opinions from Saturday, May 8 through Monday, June 7, 2021, on a draft ministerial ordinance etc. for the partial revision of the Regulations for Enforcement of the Radio Act, etc. for the necessary institutional development for frequency band expansion for the outdoor use of the microwave ultra-wideband (UWB) wireless system. As a result, four opinions were submitted. Accordingly, MIC has decided to open the submitted opinions to the public along with MIC’s views on the opinions. Furthermore, MIC made an appeal for opinions on a drafted set of revisions, including a ministerial ordinance, to partially revise the current Ministerial Ordinance Regulating Radio Equipment for necessary institutional development in response to the diversification of radio equipment and devices that use radio waves at frequencies in the 60 GHz band. As a result, ten opinions were submitted. Accordingly, MIC has decided to open the submitted opinions to the public together with MIC’s views on the opinions.
Based on the result of the opinions received, MIC submitted an inquiry about the appropriateness of the drafts to the Radio Regulatory Council (Chaired by HIBINO Takashi, Chairman of the Members of the Board and Chairman of Daiwa Securities Group Inc.) today. Then MIC received a report from the Radio Regulatory Council stating its approval as inquired.
Considering the result of the appeal for opinions and the report from the Radio Regulatory Council, MIC will promptly make necessary institutional development.

1. Result of appeal for opinions

MIC made an appeal for opinions for 31 days, from Saturday, May 8 through Monday, June 7, 2021, on a draft ministerial ordinance etc. for the partial revision of the Regulations for Enforcement of the Radio Act, relevant notices, etc. for the necessary institutional development for frequency band expansion for the outdoor use of the microwave ultra-wideband (UWB) wireless system.
Furthermore, MIC made an appeal for opinions for 31 days, from Saturday, May 15 through Monday, June 14, 2021, on a set of draft revisions. These revisions included a ministerial ordinance to partially revise the current Ministerial Ordinance Regulating Radio Equipment to make necessary institutional development possible in response to the diversification of radio equipment and devices that use radio waves at frequencies in the 60 GHz band.

2. Report from Radio Regulatory Council

With consideration of the results of the opinions received, MIC today (Wednesday, July 14) made an inquiry about items related to the Radio Act (Act No. 131 of 1950) as a part of the ministerial ordinance to partially revises the Regulations for Enforcement of the Radio Act and received a report stating its approval as drafted.

3. Future plans

With consideration of the report from the Radio Regulatory Council and the opinions submitted, MIC will promptly revise the Regulations for Enforcement of the Radio Act (Radio Regulatory Commission Rules No. 14 of 1950), Ordinance Regulating Radio Equipment (Radio Regulatory Commission Rules No. 18 of 1950), Ordinance Concerning Technical Regulations Conformity Certification of Specified Radio Equipment (Ministerial Ordinance of MPT No. 37 of 1981), relevant notices, and official directives.
