January 14, 2022 Results of Appeal for Opinions on Draft Ministerial Ordinance to Partially Revise Regulations for Enforcement of the Telecommunications Business Act and Report from Information and Communications and Posts Administrative Council

The Ministry of Internal Affairs and Communications (MIC) received a report from the Information and Communications and Posts Administrative Council on a draft ministerial ordinance for partial revisions to the Regulations for Enforcement of the Telecommunications Business Act (Inquiry No. 3144 dated November 19, 2021).
With consideration of this report, MIC will promptly revise the Ministerial Ordinance.

1. Overview

The Act on Partial Amendments to the Telecommunications Business Act (Act No. 5 of 2019) came into effect in October 2019. The draft revisions cover contracts that were concluded under the Regulations for Enforcement of the Telecommunications Business Act (Ministerial Ordinance of MPT No. 25 of 1985) prior to the enforcement of the revised Telecommunications Business Act (Act No. 86 of 1984) and do not conform to Article 27-3, paragraph 2, item 2 of the revised Telecommunications Business Act.

  Concerning the special exceptions for the partial modification of the said contracts, a provision shall be added to allow changes to be made to the contract conditions that do not conform to Article 27-3, paragraph 2, item 2 of the revised Telecommunications Business Act.

  Concerning the special exceptions for renewing the said contracts, a provision shall be added to clarify a policy to abolish the said special exceptions by the end of 2023. These revisions will eliminate the discrepancy in the said contracts as soon as possible.

2. Report and results of appeal for opinions

MIC made an appeal for opinions on this draft ministerial ordinance from Saturday, November 20 through Monday, December 20, 2021, and received five opinions.

3. Future plans

Considering the results of the appeal for opinions and the report, MIC will promptly revise the Ministerial Ordinance.
