February 2, 2022 Results of Appeal for Opinions on Draft Ministerial Ordinance for Partial Revisions to Regulations for Enforcement of the Radio Act and Pertinent Conditions and Report from Radio Regulatory Council

Institutional development to simplify periodic inspections of advanced land wireless systems

The Ministry of Internal Affairs and Communications (MIC) made an appeal for opinions from November 13 through December 13, 2021, on a drafted ministerial ordinance and pertinent conditions to partially revise the Regulations for Enforcement of the Radio Act. The subject is based on a report from a series of study meetings on the ideal periodic inspection of advanced land wireless systems. The drafted revisions simplify periodic inspections of advanced land wireless systems to maintain stable electrical characteristics. As a result, nine opinions were submitted, and MIC has decided to open the submitted opinions to the public, along with MIC’s views on the opinions.
With consideration of the results of the appeal for opinions, MIC sent an inquiry about this matter to the Radio Regulatory Council (Chaired by HIBINO Takashi, Chairman of the Members of the Board and Chairman of Daiwa Securities Group Inc.). Then, MIC received a report today stating that it is appropriate to make revisions as drafted.
Considering the results of the appeal for opinions and the report from the Radio Regulatory Council, MIC will promptly make institutional development to enact the regulations, etc.

1. Background and outline of revisions

As for the ideal state of periodic inspections of advanced land wireless systems, including 5G mobile phone and BWA systems, a report has been issued as a result of a series of study meetings on the ideal state of periodic inspections of advanced land wireless systems. This report has summarized the conditions under which electrical measurement can be omitted, based on a partial report of the Department on Information and Communications Technology under the Information and Communications Council in March 2020.
Based on the report from the study meetings, MIC made the appeal for opinions from Saturday, November 13 through Monday, December 13, 2021 on the drafted ministerial ordinances, etc. for partial revisions to the Regulations for Enforcement of the Radio Act and pertinent conditions to establish the conditions and procedures necessary for omitting the measurement of electrical characteristics in periodic inspections of base stations and facilities for advanced mobile phones.

3. Report from Radio Regulatory Council

Considering the result of the appeal for opinions, MIC submitted an inquiry today to the Radio Regulatory Council on a part related to the Radio Act (Act No. 131 of 1950) in the partial revisions to the Regulations for Enforcement of the Radio Act. Then, MIC received a report from the Radio Regulatory Council stating its approval as inquired.

4. Future plans

MIC will promptly revise the Regulations for Enforcement of the Radio Act, etc. based on the results of this report and the results of the appeal for opinions.
