March 24, 2022 Rectification Order Issued to T-Gaia Retail Service Corporation for Violation of Act on Identity Confirmation, etc. Performed by Mobile Voice Communications Carriers for their Subscribers, etc. and for Prevention of Wrongful Use of Mobile Voice Communications Services

The Ministry of Internal Affairs and Communications (MIC) issued a rectification order based on the provisions of Article 15, Paragraph 2 of the Act on Identity Confirmation, etc. Performed by Mobile Voice Communications Carriers for their Subscribers, etc. and for Prevention of Wrongful Use of Mobile Voice Communications Services (Act No. 31 of 2005, hereafter referred to as the “Act”) to T-Gaia Retail Service Corporation (headed by SENZAKI Hisae, President, Corporation Number 2010401084069, with its head office in Shibuya Ward, Tokyo) for its conduct in violation of the Act.
Furthermore, MIC instructed NTT Docomo, Inc. (headed by II Motoyuki, President and CEO, Corporation Number 1010001067912, with its head office in Chiyoda Ward, Tokyo) and T-Gaia Corporation (headed by KANAJI Nobutaka, President and CEO, Corporation Number 5011001061661, with its head office in Shibuya Ward, Tokyo), which have responsibility for supervising T-Gaia Retail Service Corporation, to ensure their supervision over intermediary agencies.

Overview of the case and details of the measures

For the purpose of preventing unauthorized use of mobile phones for crimes such as wire fraud, the Act requires that the identities of mobile phone subscribers be verified when new subscriptions are made.
T-Gaia Retail Service Corporation was found to have concluded a total of four line agreements (with individual subscribers) related to mobile voice communications services on January 10 and 21, 2021, without verifying the identities of the subscribers in the manner prescribed by the Act. Its conduct violated the provisions of Article 3, Paragraph 1 of the Act as applied mutatis mutandis pursuant to Article 6, Paragraph 3 of the Act following the deemed replacement of terms.
For this reason, on March 24, 2022, MIC ordered the company to rectify the violation under Article 15, Paragraph 2 of the Act.
Furthermore, MIC instructed NTT Docomo, Inc. and T-Gaia Corporation, which have responsibility for supervising T-Gaia Retail Service Corporation, to ensure their supervision over intermediary agencies, in view of the fact that illegal conduct took place at their agency.
MIC will continue to strictly enforce the Act.
