April 26, 2022 Solicitation of Opinions on Draft Guidelines on Certification of Information Trust Functions Ver. 2.2 and Draft Summary of Discussion on Handling of Data Profiling by Personal Data Trust Banks

The Ministry of Internal Affairs and Communications (MIC) and the Ministry of Economy, Trade and Industry (METI) held meetings of the Study Group for Certification Scheme of Information Trust Functions (chaired by SHISHIDO Joji, professor at the University of Tokyo Graduate Schools). The Study Group discussed the information trust functions that are required of what is generally called "personal data trust banks," including the review of the guidelines to make them compliant with the FY2020 and FY2021 amendments to the Personal Information Protection Act. In addition, as an issue regarding the handling of data profiling was raised, the Study Group discussed the discipline on data profiling by personal data trust banks, and prepared drafts of Guidelines on Certification of Information Trust Functions Ver. 2.2 and a Summary of Discussion on Handling of Data Profiling by Personal Data Trust Banks.
Accordingly, MIC will solicit opinions on these drafts from Wednesday, April 27 through Thursday, May 26, 2022.

1. Overview

The Study Group for Certification Scheme of Information Trust Functions (hereafter referred to as the "Study Group") held meetings and released Guidelines on Certification of Information Trust Function ver. 1.0, in June 2018, which summarized a system of private organizations' voluntary certification of personal data trust banks. In August 2019, the Study Group released ver. 2.1 of the Guideline.
The Study Group considered the review of ver.2.1 of the Guidelines to make them compliant with the 2020 and 2021 amendments to the Personal Information Protection Act. Furthermore, as an issue regarding the handling of data profiling was raised in connection with the handling of information in the fields of health care and medical care, it also discussed the discipline on data profiling by personal data trust banks.
As a result, the Study Group prepared drafts of Guidelines on Certification of Information Trust Function ver. 2.2 and a Summary of Discussion on Handling of Data Profiling by Personal Data Trust Banks.
Accordingly, MIC will solicit opinions on these drafts from Wednesday, April 27 through Thursday, May 26, 2022.
