May 27, 2022 Authorization for Changes to General Conditions of Contracts for Telegram Services of NTT East and NTT West and Changes to Telegram Service Charges

Report from the Information and Communications and Posts Administrative Council and the Results of Solicitation of Opinions

The Ministry of Internal Affairs and Communications (MIC) received today a report from the Information and Communications and Posts Administrative Council (chaired by KAWAHAMA Noboru, professor, Graduate School of Law, Kyoto University) regarding authorization for changes to the general conditions of contracts for telegram services of Nippon Telegraph and Telephone East Corporation (NTT East) and Nippon Telegraph and Telephone West Corporation (NTT West) and changes to their telegram service charges, stating that it is appropriate to grant the authorization. In consideration of this report, MIC will promptly grant the authorization relating to this case.

1. Background

On March 18, 2022, NTT East and NTT West filed the following applications with the Minister for Internal Affairs and Communications: an application for authorization for changes to the general conditions of contracts under Article 31-4, paragraph (3) of the Telecommunications Business Act (Act No. 86 of 1984; hereinafter referred to as the "Act") prior to the amendment by Article 2 of the Act Partially Amending the Telecommunications Business Act and the Act on Nippon Telegraph and Telephone Corporation (Act No. 125 of 2003) that is to remain in force pursuant to Article 5 of the Supplementary Provisions of the Act (hereinafter referred to as the "general conditions of contracts for telegram services"); and an application for authorization for changes to the charges under Article 31, paragraph (1) of the Act prior to the amendment by Article 2 of the Act on Development of the Relevant Acts for Rationalization of the Regulations in the Telecommunications Field (Act No. 58 of 1998; hereinafter referred to as the "1998 Amendment Act") that is to remain in force pursuant to Article 6, paragraph (5) of the Supplementary Provisions of the 1998 Amendment Act (hereinafter referred to as the "telegram service charges").
MIC made an inquiry to the Information and Communications and Posts Administrative Council by Inquiry No. 3149 dated March 28, 2022, regarding authorization for changes to the general conditions of contracts for telegram services and the telegram service charges, and the council solicited opinions during the period from March 29 through April 27, 2022.

2. Content of report

MIC received today a report from the Information and Communications and Posts Administrative Council regarding authorization for changes to the general conditions of contracts for telegram services of NTT East and NTT West and changes to their telegram service charges, stating that it is appropriate to grant the authorization.
In response to the solicitation of opinions, two opinions were submitted.

3. Future schedule

Based on the Council's report, MIC will promptly grant the authorization for changes to the general conditions of contracts for telegram services to NTT East and NTT West, and will request them to sufficiently inform the public of the changes and to appropriately respond to any inquiries on this matter.
In addition, MIC will promptly grant the authorization for changes to the telegram service charges after following required procedures, and will request them to sufficiently inform the public of the changes and to appropriately respond to any inquiries on this matter.
