June 30, 2022 Results of Solicitation of Opinions on Draft Ministerial Order for Partial Amendment to Ministerial Order for Partial Amendment to Order Regulating Radio Equipment and Order Concerning Technical Regulations Conformity Certification of Specified Radio Equipment

In relation to the institutional improvement regarding technical regulations for 2.3 GHz band mobile phones, the Ministry of Internal Affairs and Communications (MIC) drafted a ministerial order for partial amendment to the Ministerial Order for Partial Amendment to the Order Regulating Radio Equipment and Order Concerning Technical Regulations Conformity Certification of Specified Radio Equipment (MIC Order No. 103 of 2021), and solicited opinions on this draft from Friday, April 29 through Thursday, June 2, 2022. This amendment aims to clarify the handling of construction type certification numbers in the case of obtaining additional certification for the 2.3 GHz frequency band regarding radio equipment for mobile phones currently in use. As a result, five opinions were submitted. Accordingly, MIC discloses the submitted opinions along with MIC’s views on the opinions to the public.
MIC will promptly amend the ministerial order based on the submitted opinions.

1. Background

For the institutional improvement regarding technical regulations for 2.3 GHz band mobile phones, the ministerial order for partial amendment to the Order Regulating Radio Equipment and Order Concerning Technical Regulations Conformity Certification of Specified Radio Equipment (MIC Order No. 103 of 2021) was promulgated and put into effect on November 29, 2021.
As a result of this amendment, in the case of obtaining additional construction type certification for the 2.3 GHz band with regard to radio equipment for mobile phones currently on the market, it may be necessary to obtain additional certification for specified radio equipment under certain conditions. In order to clarify the handling of certification numbers in such case, MIC drafted a ministerial order for partial amendment to the Ministerial Order for Partial Amendment to the Order Regulating Radio Equipment and Order Concerning Technical Regulations Conformity Certification of Specified Radio Equipment, and solicited opinions on this order from Friday, April 29 through Thursday, June 2, 2022.

2. Future schedule

MIC will promptly amend the ministerial order based on the submitted opinions.
