September 1, 2022 Results of Solicitation of Opinions on Draft Ministerial Order for Partial Amendment to Regulation for Enforcement of the Radio Act and Other Draft Amendments, and the Enactment, Revision, or Repeal of Relevant Notices, and Report from the Radio Regulatory Council

Regarding the institutional development including the legislation of ministerial orders involved by the enforcement of the Act Partially Amending the Radio Act and Broadcast Act (Act No. 63 of 2022; hereinafter referred to as the “Amendment Act”), the Ministry of Internal Affairs and Communications (MIC) solicited opinions from Friday, July 8 though Monday, August 8, 2022, on its draft ministerial order for partial amendments to the Regulations for Enforcement of the Radio Act (excluding sections related to exemptions from the procedure for the solicitation of opinions), and the enactment, revision, or repeal of relevant notices. As a result, six opinions were submitted. Accordingly, MIC discloses the submitted opinions along with MIC’s views on the opinions to the public.
Considering the results of the opinions received, MIC submitted an inquiry about consultation matters relating to the draft ministerial order in question based on the provisions of Article 2, Paragraph 1, Item 1 of the Supplementary Provisions of the Amendment Act and Article 99-11, Paragraph 1, Item 1 of the Radio Act (Act No. 131 of 1950) to the Radio Regulatory Council (Chaired by HIBINO Takashi,Chairman of the Board, Daiwa Securities Group Inc.) today. Then MIC received a report from the Radio Regulatory Council stating its approval regarding the appropriateness of the finalized draft.
MIC will promptly make institutional development for the relevant ministerial order, based on the results of opinions submitted and the report from the Radio Regulatory Council.

1. Overview

The Amendment Act promulgated on June 10, 2022, comes into effect on the day specified by Cabinet Order (October 1, 2022) within a period not exceeding nine months from the date of promulgation, except for some of the provisions.
In order to implement institutional development for this, MIC solicited opinions from Friday, July 8 though Monday, August 8, 2022, on its draft ministerial order for partial amendments to the Regulations for Enforcement of the Radio Act (excluding sections related to exemptions from the procedure for the solicitation of opinions), and the enactment, revision, or repeal of relevant notices.

2. Report from the Radio Regulatory Council

With consideration of the results of the solicitation of opinions, MIC submitted an inquiry about consultation matters relating to the draft ministerial order in question based on the provisions of Article 2, Paragraph 1, Item 1 of the Supplementary Provisions of the Amendment Act and Article 99-11, Paragraph 1, Item 1 of the Radio Act to the Radio Regulatory Council about consultation matters based on the Radio Act in the draft Ministerial Order for Partial Amendment to the Order Regulating Radio Equipment today. Then, MIC received a report from the Council today stating its approval for the draft.

3. Future schedule

MIC will promptly make the institutional development of relevant regulations based on the results of opinions submitted and the report from the Radio Regulatory Council.
