September 1, 2022 Results of Opinions Submitted and Report from Radio Regulatory Council Regarding the Institutional Development Including the Legislation of Ministerial Orders Involved by the Enforcement of the Act Partially Amending the Broadcast Act

The Ministry of Internal Affairs and Communications (MIC) solicited opinions from July 12 through August 10, 2022, on a draft ministerial order for partial amendments to Regulations for Enforcement of the Broadcast Act in order to implement institutional development including the legislation of ministerial orders involved by the enforcement of the Broadcast Act, etc. As a result, 50 opinions were submitted. Accordingly, MIC discloses the submitted opinions along with MIC’s views on the opinions to the public.
With consideration of the results of the solicitation of opinions, MIC submitted an inquiry to the Radio Regulatory Council (Chaired by HIBINO Takashi, Chairman of the Board of Daiwa Securities Group Inc.) today about the proposal to set the upper limit on the extra charge that Japan Broadcasting Corporation can levy as double the amount of the receiver's fee. Then, MIC received a report from the Council stating its approval for the drafts.
MIC will promptly make institutional development for the relevant ministerial orders, based on the results of opinions submitted and the report from the Radio Regulatory Council.

1. Results of public solicitation of opinions

The Act Partially Amending the Radio Act and Broadcast Act (Act No. 63 of 2022) (hereinafter referred to as the "Amendment Act") promulgated on June 10, 2022, comes into effect on the day specified by Cabinet Order within a period not exceeding nine months from the date of promulgation, except for some of the provisions. Among the development of provisions involved by the enforcement of the Act, MIC solicited opinions for a 30-day period from July 12 through August 10, 2022, regarding the development of provisions on the authorization of investment in holding companies in the relevant business by Japan Broadcasting Corporation, and provisions on extra charge systems, along with draft amendments to ministerial orders.

2. Report from the Radio Regulatory Council

Considering the results of the opinions received, MIC submitted an inquiry about the proposal to set the upper limit on the extra charge that Japan Broadcasting Corporation can levy as double the amount of the receiver's fee to the Radio Regulatory Council today (Thursday, September 1), and received a report from the Council stating its approval regarding the appropriateness.

3. Future schedule

MIC will promptly make institutional development for the relevant ministerial orders including the proposal to set the upper limit on the extra charge as double the amount of the receiver's fee, based on the report from the Radio Regulatory Council and the results of opinions submitted.
