September 28, 2022 Decision of Effective Use Evaluation Policy and the Result of Solicitation of Opinions

Based on the result of the solicitation of opinions implemented from Saturday, July 16, through Friday, August 19, 2022, the Radio Regulatory Council (Chaired by HIBINO Takashi, Chairman of the Members of the Board of Daiwa Securities Group Inc.) decided today and publishes the "Policy on the Standards and Methods for the Effective Use Evaluation and Other Matters Necessary for Implementing the Effective Use Evaluation."

1. Background

Article 26-3 of the Radio Act (Act No. 131 of 1950) amended by the Act Partially Amending the Radio Act and Broadcast Act (Act No. 63 of 2022) stipulates that upon receiving the result of the survey on actual radio spectrum usage from the Minister for Internal Affairs and Communications, the Radio Regulatory Council will conduct an "Evaluation of the Degree of Effective Use of Radio Waves" (hereinafter referred to as the "Effective Use Evaluation") based on the result, and sets forth and announces the "Policy on the Standards and Methods for the Effective Use Evaluation and Other Matters Necessary for Implementing the Effective Use Evaluation" (hereinafter referred to as the "Effective Use Evaluation Policy") in advance.
According to Article 2, Paragraph 2 of the Supplementary Provisions of the Amendment Act, the Radio Regulatory Council may set forth and announce the Effective Use Evaluation Policy even before the date on which the Amendment Act comes into effect. The Radio Regulatory Council prepared a Draft Effective Use Evaluation Policy, and solicited opinions on the draft from Saturday, July 16, to Friday, August 19, 2022. As a result, 12 opinions were submitted. Based on such opinions submitted, the Council conducted deliberation on Thursday, September 1, and Wednesday, September 28, 2022, and decided the Effective Use Evaluation Policy.

2. How to obtain reference information

MIC will make the press release available for viewing and obtaining copies at the General Affairs Division, Telecommunications Bureau, MIC.
They will also be posted on the public comment page of the e-Gov (https://www.e-gov.go.jp/).

3. Future schedule

Upon receiving the result of the survey on actual radio spectrum usage conducted by MIC, the Radio Regulatory Council will conduct the Effective Use Evaluation based on the result.
