November 15, 2023 Results of Solicitation for Opinions on Draft Ministerial Ordinance, etc., to Partially Amend Regulations for Enforcement of the Radio Act and Report from Radio Regulatory Council Institutional development for the introduction of broadband wireless LANs, etc.

The Ministry of Internal Affairs and Communications (MIC) solicited opinions from Saturday, September 23 through Monday, October 23, 2023, on a draft ministerial ordinance, etc., for partial amendments to the Regulations for Enforcement of the Radio Act, etc., in order to make institutional development for the introduction of broadband wireless LANs, etc. As a result, MIC received 14 opinions. Accordingly, MIC has decided to open the submitted opinions and MIC’s views on them to the public.
With consideration of the results of the solicitation for opinions, MIC sent an inquiry to the Radio Regulatory Council (chaired by SASASE Iwao, Professor Emeritus at Keio University) to partially amend the Regulations for Enforcement of the Radio Act (Regulations of the Radio Regulatory Commission No. 14 of 1950), etc. today, and received a report to the effect that it is appropriate to adopt the drafts as proposed.
MIC will promptly make relevant institutional developments based on the results of the solicitation for opinions and the report from the Radio Regulatory Council.

1. Background and amendments overview

The Institute of Electrical and Electronics Engineers (IEEE), which compiles international standards for wireless LANs, is currently discussing the IEEE 802.11be, the next wireless LAN standard after the current IEEE 802.11ax. By making these standards available in Japan, it is expected that new uses and innovations of wireless LANs will be created.
Against this background, the Information and Communications Council (chaired by ENDO Nobuhiro, Executive Advisor of NEC Corporation) has been studying the issue. MIC received a partial report from the Information and Communications Council on technical requirements for introducing broadband wireless LANs and technical requirements for upgrading wireless LAN systems on Tuesday, September 12 of this year.
In light of this, MIC has prepared the draft ministerial ordinance and pertinent conditions for the partial amendments to the Regulations for Enforcement of the Radio Act, etc., to develop provisions related to the introduction of broadband wireless LANs and LPI Client-to-Client device communications under 6 GHz-band LPI, and the review of 5.2 GHz-band intra-vehicle wireless LANs. Accordingly, MIC solicited opinions on them from Saturday, September 23, through Monday, October 23, 2023.

(3) Draft Notice for Partial Amendments to MIC Notice No. 48 of 2007 (to specify technical requirements for radio equipment of radio stations for low-power data communication systems)
(4) Draft Notice for Partial Amendments to MIC Notice No. 291 of 2022 (to specify technical requirements for radio stations of low-power data communication systems based on the provisions of Article 49-20, Item 4 of the Ordinance Regulating Radio Equipment Article 49)
(5) Draft Notice for Partial Amendments to MIC Notice No. 437 of 2015 (to specify technical standards designated by the Minister for Internal Affairs and Communications as technical standards equivalent to the technical standards specified in Chapter III of the Radio Act under Article 4-2 paragraph (7) of the same Article paragraph (1) of the same Act) to be partially amended
(6) Draft Notice for Partial Amendments to MIC Notice No. 263 of 2019 (to specify technical standards designated by the Minister for Communications as technical standards equivalent to the technical standards specified in Chapter III of the Radio Act under Article 4-2, paragraph (7) of the same Article, paragraph (2) of the same Act), to be partially amended
(7) Draft Notice for Partial Amendments to MIC Notice No. 438 of 2015 (to specify the conditions to be notified separately by the Minister for Internal Affairs and Communications as stipulated in Article 6-2-3 of the Regulations for Enforcement of the Radio Act)

3. Results of solicitation for opinions

The submitted opinions and MIC’s views on them are shown in the attachment.

4. Report from Radio Regulatory Council

Based on the results of the solicitation for opinions, MIC sent an inquiry to the Radio Regulatory Council today on the draft ministerial ordinance, etc., to partially amend the Regulations for Enforcement of the Radio Act, etc., and received a report to the effect that the draft is appropriate.

5. Future plans

Based on the results of the solicitation for opinions and the report from the Radio Regulatory Council, MIC will promptly make relevant institutional developments.
