November 16, 2023 Results of Solicitation for Opinions on Draft Ministerial Ordinance Partially Amending the Ministerial Ordinance for Specified Business Operators of MIC-related Social Infrastructures, based on the Act on the Promotion of Ensuring National Security through Integrated Implementation of Economic Measures

The Ministry of Internal Affairs and Communications (MIC) solicited opinions on a draft ministerial ordinance from Saturday, September 16 through Monday, October 16, 2023, to partially amend the Ministerial Ordinance for Specified Business Operators in MIC-related Social Infrastructures, based on the Act on the Promotion of Ensuring National Security through Integrated Implementation of Economic Measures.

1. Overview

Some provisions of the Act on the Promotion of Security Assurance through Integration of Economic Measures (hereafter referred to as the “Economic Security Promotion Act”) are set to come into effect on a date specified by a Cabinet Order within a period not exceeding one year and nine months from the date of promulgation.
MIC will develop the relevant provisions necessary to implement part of the institution to ensure the stable provision of core infrastructure services specified by the Economic Security Promotion Act. For this purpose, the Ministerial Ordinance for Specified Business Operators in MIC-related Social Infrastructures, based on the Act on the Promotion of Ensuring National Security through Integrated Implementation of Economic Measures is to be amended to specify the constituent facilities, important maintenance management, etc., and notification procedures, etc. of specified critical facilities.

2. Results of solicitation for opinions

MIC has prepared the draft ministerial ordinance to partially amend the Ministerial Ordinance concerning Specified Social Infrastructure Operators, etc., based on the Act on the Promotion of Ensuring National Security through Integrated Implementation of Economic Measures related to MIC. In accordance with the Administrative Procedure Act (Act No. 88 of 1993), solicitation for opinions was held from September 16 (Saturday) to October 16 (Monday), 2023.
In response to the solicitation for opinions, MIC received 16 opinions. The opinions submitted, and the MIC’s views on them are shown in the attachment.

3. Promulgation and enforcement of Ministerial Ordinance

Based on the results of solicitation for opinions, etc., the Ministerial Ordinance has been promulgated today.
