November 22, 2023 Results of Solicitation for Opinions on Partial Amendments to Regulations for Enforcement of Telecommunications Business Act and Report from Information and Communications and Posts Administrative Council Institutional development based on the discussions of the WG on Verification of Competition Rules

The Ministry of Internal Affairs and Communications (MIC) received today a report from the Information and Communications and Posts Administrative Council (chaired by AIDA Hitoshi, professor emeritus at the University of Tokyo) on the Partial Amendment of the Regulations for Enforcement of the Telecommunications Business Act (Inquiry No. 3173 dated October 6, 2023), based on the results of solicitation of opinions conducted by the Council From Saturday, October 7 through Monday, November 6, 2023.
MIC will promptly amend the Ministerial Ordinance, etc., based on this report and surrounding conditions.

1. Overview

The Working Group (WG) on Verification of Competition Rules (headed by Chief Investigator NIIMI Ikufumi, Professor Emeritus at Meiji University) of the Meeting for Telecommunications Market Validation examined the status of enforcement of the provisions of Article 27-3, Paragraphs 1 and 2 of the Telecommunications Business Act (Act No. 86 of 1984) based on Article 6 of the Supplementary Provisions of the Act Partially Amending the Telecommunications Business Act (Act No. 5 of 2019), which came into force in October 2019. This matter is to partially amend the Rules for Enforcement of the Telecommunications Business Act (Ministerial Ordinance of MPT No. 25 of 1985), etc., based on the “Report on Verification of Competition Rules 2023” compiled by the WG.

2. Contents of the report

The contents of the report, including the opinions submitted in response to the solicitation for opinions conducted by the Information and Communications and Posts Administrative Council and the Council’s views on the opinions, are shown in Attachment 2.

3. Future plans

Based on the results of the solicitation for opinions, the report, etc., MIC will promptly amend the Ministerial Ordinances etc.
