December 4, 2023 Results of Solicitation for Opinions on Draft Amendments to Guidelines for Operation of Article 27-3 of the Telecommunications Business Act and Release of Amended Guidelines

The Ministry of Internal Affairs and Communications (MIC) solicited opinions on draft amendments to the Guidelines for Operation of Article 27-3 of the Telecommunications Business Act from Thursday, October 26 through Friday, November 24, 2023. As a result, nine opinions were submitted, and MIC will open the submitted opinions and MIC’s opinions on them, as well as the amended guidelines.

1. Results of solicitation for opinions

The Guidelines for the Operation of Article 27-3 of the Telecommunications Business Act (hereafter referred to as “the Operational Guidelines”) have been established to show the concrete concept and case examples of the operation of Article 27-3 and relevant provisions of the Telecommunications Business Act (Act No. 86 of 1974, hereafter referred to as the “Act”).

Based on Article 6 of the Supplementary Provisions of the Act Partially Amending the Telecommunications Business Act (Act No. 5 of 2019), MIC plans to amend the Regulations for Enforcement of the Telecommunications Business Act (Ministerial Ordinance of MPT No. 25 of 1985) and relevant regulations with consideration of the results of a study of the status of enforcement of the provisions of Article 27-3, Paragraphs 1 and 2 of the Act. With regard to these amendments, MIC decided to amend the Operational Guidelines in order to organize specific ideas and examples for the implementation of the amendments and solicited opinions on the drafted amendments from Thursday, October 26 through Friday, November 24, 2023.
The results of solicitation for opinions resulted in nine opinion submissions. The opinions submitted, and MIC’s views on them are shown in the attachment.

2. Revision of Operational Guidelines

Based on the results of the solicitation for opinions, MIC has revised the Guidelines for Operation of 27-3 of the Telecommunications Business Act (Amendment indicated version: Attachment 1 in PDF, Revised version: Attachment 2 in PDF).
