March 8, 2023 Results of Solicitation of Opinions on Draft Cabinet Order for Partial Amendment to Cabinet Order for Enforcement of the Broadcast Act and Other Draft Amendments, and Report from the Radio Regulatory Council

The Ministry of Internal Affairs and Communications (MIC) solicited opinions from January 18 through February 16, 2023, on a draft cabinet order for partial amendments to the Cabinet Order for Enforcement of the Broadcast Act and other draft amendments, to be put in place as institutional development of cabinet and ministerial orders required for the enforcement of part of the Act Partially Amending the Radio Act and Broadcast Act (Act No. 63 of 2022), which was enacted at the 208th session of the National Diet. As a result, 10 opinions were submitted. Accordingly, MIC discloses the submitted opinions along with MIC's views on the opinions to the public.
After considering the results of the solicitation of opinions, MIC submitted an inquiry today about a draft ministerial order for partial amendments to the Regulations for Enforcement of the Broadcast Act and other draft amendments to the Radio Regulatory Council (chaired by SASASE Iwao, Professor Emeritus, Keio University), and has received a report from the Council, approving the draft as appropriate.
MIC will promptly carry out the institutional development of the relevant cabinet and ministerial orders, etc., based on the results of opinions submitted and the report from the Radio Regulatory Council.

1. Results of solicitation of opinions

Some provisions of the Act Partially Amending the Radio Act and Broadcast Act (Act No. 63 of 2022; hereinafter referred to as the "Amendment Act") promulgated on June 10, 2022, come into effect on the day specified by Cabinet Order within a period not exceeding one year from the date of promulgation. In order to carry out institutional development of the relevant provisions ahead of the partial entry into force of the Amendment Act, MIC solicited opinions over a 30-day period from January 18 through February 16, 2023, on a draft cabinet order for partial amendments to the Cabinet Order for Enforcement of the Broadcast Act, a draft cabinet order for partial amendments to the Cabinet Order for Enforcement of the Radio Act, a draft ministerial order for partial amendments to the Regulations for Enforcement of the Broadcast Act, a draft official directive for partial revision of the Examination Standards Related to the Broadcast Act, and a draft official directive for partial revision of the Examination Standards Related to the Radio Act.

2. Report from the Radio Regulatory Council

After considering the results of the solicitation of opinions, MIC submitted an inquiry today about the draft ministerial order for partial amendments to the Regulations for Enforcement of the Broadcast Act and other draft amendments to the Radio Regulatory Council today, and received a report from the Council, approving the drafts as appropriate.

3. Future plans

MIC will promptly carry out the institutional development of the relevant cabinet and ministerial orders, etc., based on the results of opinions submitted and the report from the Radio Regulatory Council.
