March 8, 2023 Results of Solicitation of Opinions on Draft Ministerial Order for Partial Amendments to Regulations for Enforcement of the Radio Act and Regulations for Procedure for Obtaining a Radio Station License and Other Draft Amendments, and Report from the Radio Regulatory Council

The Ministry of Internal Affairs and Communications (MIC) solicited opinions from Wednesday, December 28, 2022 through Tuesday, January 31, 2023, on a draft ministerial order for partial amendments to the Regulations for Enforcement of the Radio Act and the Regulations for Procedure for Obtaining a Radio Station License, and a draft official directive for partial revision of the Examination Standards Related to the Radio Act, in order to carry out institutional development relating to matters set out in the Report of the Task Force on Facilitating Migration in the Reallocation of Mobile Phone Frequencies. As a result, 6 opinions were submitted. Accordingly, MIC discloses the submitted opinions along with MIC's views on the opinions.
After considering the results of the solicitation of opinions, MIC today submitted an inquiry to the Radio Regulatory Council (chaired by SASASE Iwao, Professor Emeritus, Keio University) about those consultation matters in the draft ministerial order in question based on the provisions of Article 99-11, Paragraph 1, Item 1 of the Radio Act (Act No. 131 of 1950), and has received a report from the Council, approving the draft as appropriate. MIC will promptly carry out the institutional development of the relevant provisions, based on the report from the Radio Regulatory Council.

1. Overview

After being set up in February 2022, the Task Force on Facilitating Migration in the Reallocation of Mobile Phone Frequencies undertook deliberations about such matters as the migration period required in the event of a decision to institute establishment guidelines following an application to institute such guidelines, and approaches to the burden of costs associated with migration. The Task Force then compiled a report in December 2022.
MIC solicited opinions from Wednesday, December 28, 2022 through Tuesday, January 31, 2023, on a draft ministerial order for partial amendments to the Regulations for Enforcement of the Radio Act and the Regulations for Procedure for Obtaining a Radio Station License, and a draft official directive for partial revision of the Examination Standards Related to the Radio Act, in order to carry out institutional development relating to matters set out in the report.

2. Report from the Radio Regulatory Council

After considering the results of the solicitation of opinions, MIC today submitted an inquiry to the Radio Regulatory Council about those consultation matters in the draft ministerial order for partial amendments to the Regulations for Enforcement of the Radio Act and the Regulations for Procedure for Obtaining a Radio Station License based on the provisions of Article 99-11, Paragraph 1, Item 1 of the Radio Act, and has received a report from the Council, approving the draft as appropriate.

3. Future schedule

MIC will promptly make the institutional development of relevant regulations based on the results of the solicitation of opinions and the report from the Radio Regulatory Council.
