April 20, 2023 Revision of the Basic Guidelines regarding Designation of Telecommunications Carriers pursuant to the Provisions of Article 30, Paragraph 1 and Paragraph 3, Item 2 of the Telecommunications Business Act

The Ministry of Internal Affairs and Communications (MIC) announces the revised the Basic Guidelines regarding Designation of Telecommunications Carriers pursuant to the Provisions of Article 30, Paragraph 1 and Paragraph 3, Item 2 of the Telecommunications Business Act.

1. Overview

Concerning the Designation of Telecommunications Carriers as the party receiving the Acts Prohibited pursuant to the Provision of Article 30, Paragraph 3, Item 2 of the Telecommunications Business Act (Act No. 86 of 1984), MIC solicitated opinions on Draft Partial Amendment of Draft Partial Amendment of the Designation Notice (*1) and Draft Revision to Related Guidelines (*2) from Saturday, January 21 through Monday, February 20, 2023. The Information and Communications and Posts Administrative Council reported on the partial revision of the Designation Notice, dated March 24, 2023.

*1. MIC Notice No. 221 of 2016 (Notice Related to Designation of　Telecommunications Carriers as the party receiving to Acts Prohibited pursuant to the Provision of Article 30 Paragraph 3 Item 2 of the Telecommunications Business Act)

*2. Basic Guidelines regarding Designation of Telecommunications Carriers pursuant to the Provisions of Article 30, Paragraph 1 and Paragraph 3, Item 2 of the Telecommunications Business Act (revised by MIC on March 29, 2016) In consideration of the report, a Notice revising a part of the Designation Notice was promulgated today.

In accordance with this, the Basic Guidelines regarding Designation of Telecommunications Carriers pursuant to the Provisions of Article 30, Paragraph 1 and Paragraph 3, Item 2 of the Telecommunications Business Act has been revised to clarify the content of the description, and is announced.
