July 31, 2023 Results of Solicitation for Opinions on Partial Amendments to the Regulations for Enforcement of the Telecommunications Business Act, etc., and Report from the Information and Communications and Posts Administrative Council Institutional review in light of consecutive telecommunications accidents

The Ministry of Internal Affairs and Communications (MIC) submitted an inquiry (inquiry No. 3166) to the Information and Communications and Posts Administrative Council on Friday, May 26, 2023, regarding a draft ministerial ordinance partially amending the Regulations for Enforcement of the Telecommunications Business Act and Regulations for Telecommunications Facilities for Telecommunications Business, and solicited opinions on the said draft ministerial ordinance, etc. As a result, three opinions were submitted. Accordingly, MIC has decided to open these opinions to the public, along with MIC’s views on the opinions.
Based on the solicitation results for opinions, the Council reported today that it is appropriate to amend them as inquired.
With consideration of the results of the solicitation for opinions, this report, etc., MIC plans to promptly amend the Regulations for Enforcement of the Telecommunications Business Act, etc.

1. Summary of amendments

Taking into account the report on the examination of structural problems relating to telecommunications accidents, compiled by the Telecommunications Accident Verification Meeting on Monday, March 27, 2023, MIC is amending the Rules for Enforcement of the Telecommunications Business Act (Ministry of Posts and Telecommunications Ordinance No. 25 of 1985), among others.

2. Results of solicitation for opinions and report

With regard to the partial amendments to the Regulations for Enforcement of the Telecommunications Business Act, etc., MIC solicited opinions from Saturday, May 27 through Monday, June 26, 2023, and received three opinions.
Today, after deliberation based on the submitted opinions by the Information and Communications and Posts Administrative Council, MIC received a report stating the appropriateness of amending the regulations as inquired.

3. Future plans

MIC will promptly make institutional development based on this report and the results of the solicitation for opinions.
